AN ORDINANCE FOR ASSEMBLY HALL/INDOOR AUDITORIUM (SEC. 64-1846) LOCATED
AT 3100 HERITAGE WALK. SUITE 301 WITHIN THE TS and T4 OPEN TRANSECT ZONES OF
THE CRABAPPLE FORM BASED CODE
BE IT ORDAINED by the City Council for the City of Milton, Georgia while in regular
session on Mayl 5, 2023 at 6:00 p .m. as follows:
SECTION 1. That the Zoning Ordinance of the City of Milton be amended , so
that the following property located at 3100 Heritage Walk, Suite 301, consisting of a
total of approximately 3.85 acres as shown on the survey attached hereto as Exhibit
"A" and more specifically described as Suite 301 at Heritage Walk , be approved for
a Use Permit for Assembly Hall/Indoor Auditorium subject to the Conditions of
Approval described in Exhibit "B": and
SECTION 2. That the Assembly Hall/Indoor Auditorium listed in the attached
conditions of approval, be approved under the provisions Sec. 64-1846 of the
Zoning Ordinance of the City of Milton; and
SECTION 4. That the property shall be developed in compliance with the
Conditions of Approval as described as attached; provided that no uses or
conditions hereby approved (including any site plan) shall authorize the violation of
any district regulations or other zoning regulations; and
SECTION 5 . That all ordinances or part of ordinances in conflict with the
terms of this ordinance are hereby repealed; and
SECTION 6. This Ordinance shall become effective upon adoption by the
Mayor and City Council and the signature of approval of the Mayor.

EXHIBIT "B"
CONDITIONS OF APPROVAL
Property located at 3100 Heritage Walk , Suite 30 l for a Use Permit for an Assembly Hall/Indoor
Auditorium (Sec . 64-1846) subject to the owner's agreement to the following enumerated
conditions. Where these conditions conflict with the stipulations and offerings contained in the Letter
of Intent, these conditions shall supersede unless specifically stipulated by the Mayor and City
Council.
l) To the owner 's agreement to restric t the use of the subject property as follows:
a) Restrict the use of 3100 Heritage Walk, Suite 301 to an Assembly Hall/Indoor Auditoriu m .
b) Restrict the total square footage of the Assembly Hall/Indoor Auditorium at 3100 Heritage
Walk , Suite 301 to 4,000 sq uare feet.
c) Restrict the maximum number of attendees of the Assembly Hall/Indoor Auditorium to
150.
2) To the owner 's agreement to abide by the following :
a) Substantial compliance with the site plan received by the Community Developmen t
Department on November 29 , 2022 , whereby the exact layout of the project may
contain minor deviations approved by the Commu nity Development Director provided
the deviations remain consistent with the purpose and inte nt of the Council's approval of
the Use Permit . Notwithstanding the contents of the site plan, the project must meet or
exceed the requirements of the Zoning Ordinance, all other applicable city ordinances
and these conditions prior to the approval of a Land Disturbance Permit.
The site plan may be revised with the approval of the Community Development Director
in order to comply w it h city codes and zoning conditions. Unless otherwise noted herein ,
compliance with all conditions shall be in place prior to the issuance of the first
Certificate of Occupancy.
b) · The applicant shali provide either offsite parking or a transportation option to facilitate
rides such that the total number of additional parking spaces and transportation options
actually utilized shall be at least 0.5 parking spaces per attendee over 30 attendees.
