AN ORDINANCE TO AMEND SEC. 64-77 MINIMUM BUILDING LINES, (CHAPTER 64 OF THE CITY
CODE) AS IT RELATES TO FLAG LOTS
BE IT ORDAINED by the City Council of the City of Milton, GA while in a regularly called council
meeting on September 6, 2023, at 6:00 p .m. as follows :
SECTION 1. Th at the amended zoning o rdinanc e as it re lates to flag lots is hereby
adopted and approved; and is attached hereto as if fully set forth therein; and
SECTION 2. That the amendments of Sec. 64-77 are hereby adopted and approved; and
are attached hereto as if fully set forth herein ; and
SECTION 3. All ordinances, parts of o rdinances, or regulations in confl ict herewith are
repealed; and
SECTION 4. That this Ord in ance shall become effective upon its adopti o n .

Sec. 64-77. Minimum building lines.
The minimum yards (setbacks) in each district shall establish minimum building lines for all structures except those named in
section 64-49 entitled, "Uses and structures permitted in yards; outside storage ."
(1) Multiple frontage lots . Lots adjoining more than one public street shall provide a minimum front yard along each right-
of-way except corner lots . The setbacks for the street adjoining side yards of corner lots shall be as specified in the
district regulations .
(2) Permitted encroachments into yards. The following encroachments shall be allowed to the extent specified :
a. Nonresidential. Canopies shall be allowed over walkways or driveways to within 12 feet of the street right-of-way or
the right-of-way based on the street's functional classification, whichever is farther from the street's centerline. Fuel
pumps and pump islands, when permitted, shall be set back as stated in this subsection for canopies.
b. Residential. Single-family residential and townhouses used for single -family on individual lots of record .
1. Porches, decks or patios attached to the main dwelling may extend no more than ten feet into a minimum front or
rear yard .
2. Outdoor fireplaces and outdoor uncovered kitchens, whether standalone or constructed as a part of a patio,
retaining wall or other structure, may only be loca ted in the rea r yard and may extend no more than ten feet into
the minimum rear yard. In no case shall an outdoor fireplace be located closer than ten feet to a property line .
3. Awnings may project to within five feet of a side lot line .
c. All zoning districts. Architectural features such as cornices, eaves, steps, gutters, fire chases, chimneys which are a part
of an exterior wall of the primary structure, and fire escapes may not encroach or project over more than 36 inches
into any minimum yard .
d. Adjoining railroads . For those uses which utilize a rail siding for loading and unloading, there shall be no minimum rear
yard requirement adjoining the siding.

a. Requirements
1. A flag lot shall be a minimum of one and one-half (1 ½) acres in size except where an existing structure is to
remain. and the newly created flag lot can be a minimum of one acre in size.
2. The stem of the flag lot shall constitute no more than ten percent (10 %) of the total lot size .
3. A flag lot stem shall not be less than 1s feet in width .
4. Minimum yards shall not be identified within the stem portion of a flag lot unless such portion. independent of the
flag portion, can meet the requirements of section 64-46 .
s. Measurements for a front yard setback shall begin at the point of intersection of the stem and the flag portion of a
-fla g lot running along the property line the most perpendicular to the stem.
6. Flag lots are prohibited in a major subdivision .
