R24-02-687 A RESOLUTION TO ADOPT A CITY OF MILTON RESIDENTIAL SPEED ZONE PROGRAM POLICY AND PROCEDURES BE IT RESOLVED by the City Council of the Ci ty of Milton, Georgia w hil e in Regu lar called Counci l meeting on t he 21 st day of February 2024 at 6:00 p.m . as follows: SECTION 1. That the Residential Speed Zone Program Policy and Procedures for th e City of Milton , attached hereto and incorpora ted herein by reference as Exhibit "A," is hereby adopted and approved; a nd , SECTION 2. MILTON ~ Public Works Department STANDARD OPERATING PROCEDURES SOP NUM BER: PW-24-001 SOP TITLE: Residential Speed Zone Program AUTHOR(S): Sara Leaders EFFECTIVE DATE: 2/22/24 ISSUE DATE: 2/22/24 REVISION DATE: N/A COUNCIL APPROVAL: 2/21 /24 PURPOSE The objective of thi s Standard Operating Procedure (SOP) is to establish a policy and procedure for the City of Milton Residential Speed Zone Program. SCOPE This SOP is a mandatory document unless otherwise specified that applies to all staff that interact with the program. This SOP will cover the policy guidelines and the process to add a street as a Residential Speed Zone. DELIVERABLES The City of Milton may utilize a Residential Speed Zone program for eligible residential streets within the City of Milton in accordance with O.C .G.A. § 40-14-S(b) and designated by the Mayor and City Council. RESPONSIBILITIES All applicable staff will adhere to this policy and follow the established procedures for the City of Milton Residential Speed Zone Program. The city, at its discretion, may designate Residential Speed Zones without an application or petition requirement when in the best interest of public safety. DEFINITIONS Applicant -A person having the authority to act on behalf of a subdivision or Study Area. In the case of a mandatory Homeowners Association (HOA), the application must be filed by a member of the board authorized to act on behalf of the HOA. Where an HOA is not considered mandatory, the application must be made by a person authorized to act on behalf of the residents within the Study Area. Eligible Residential Street -Local residential street at least 0.25 miles in length with an Average Daily Traffic (ADT) of at least 100 vehicles per day as determined by Milton Public Works and which have a posted speed limit of 25 mph to 30 mph. MILTON\,--Public Works Department STANDARD OPERATING PROCEDURES List of Roads -Roads that are approved on the City of Milton Radar Permit by the Georgia Department of Transportation (GDOT) and Georgia Department of Public Safety (GDPS). Local Residential Streets -Streets that are primarily used for direct access to property and connections to higher order systems, with adjacent land use that is primarily residential in nature. Petition -Document signed by residents within a Study Area recording support of a proposed Residential Speed Zone designation. Radar Permit -Georgia Department of Public Safety issued permit, as provided by law, to the City of Milton for the use of speed detection on the List of Roads . Residential Speed Zone -Eligible residential streets within the City of Milton in accordance with O .C.G.A. § 40-14-8(b) and designated by the Mayor and City Council as part of the List of Roads Study Area -Any lot with a driveway directly connected to the requested street or lot with driveway on intersecting streets that has no other outlet. PROCEDURES Process • An Applicant may submit a request for Residential Speed Zone designation to the Public Works Department (Public Works) on a form provided by the city. • Public Works will review the request to determine Eligible Residential Streets and the proposed Study Area (this may include roadway measurements and collecting traffic count data) and will notify the Applicant of the findings. • If one or more Eligible Residential Street are available to be considered as a Residential Speed Zone , the Applicant must return a petition to Public Works with at least 67% support from the property owners within the Study Area (Petition requirements are below). • Once the Petition is verified , Public Works will confirm the proposed Residential Speed Zone Street is on the Radar Permit List of Roads. • If the street is not on the Radar Permit List of Roads , Public Works will follow its procedures to request for the street(s) to be added. • With the street confirmed on the Radar Permit , Public Works staff will present a resolution on a regular City Council meeting as a new business item for consideration to modify the List of Roads to include designation of the City's Residential Speed Zones. • Public Works will properly mark the Residential Speed Zone with regulatory signage. • If the Applicant decides that it no longer wants the Residential Speed Zone , the Applicant must follow the same procedure to obtain 67 percent of the Public Works Department STANDARD OPERATING PROCEDURES 3 homeowners in the Study Area to vote in favor of the removal of the Residential Speed Zone. A Residential Speed Zones shall remain in place at least 12 months before it can be requested to be removed. Applicant Petition Process The city requires that there be wide support from the community for implementing Residential Speed Zones. An Applicant must present a Petition signed by at least 67 percent of the homeowners within the Study Area indicating they are in favor of the proposed Residential Speed Zone designations. The completed Petition must be returned to Public Works where it will be validated. Percentages will be calculated based on the number of lots signing the Petition indicating support divided by the total number of lots in the Study Area. Each lot, including undeveloped lots, counts as only one vote regardless of the number of owners that may sign for a lot. All owners are not required to sign for a lots vote to count. Renting tenants are not an acceptable substitute for the legal lot owner. Petition signatures older than 12 months from the date of submittal will be considered invalid. The Applicant must show a minimum of 67% support within the Study Area to pass. The city will provide a sample petition form. City of Milton Police Department Procedures Police will develop and utilize a traffic enforcement strategy for Residential Speed Zones.
