HomeMy WebLinkAboutOrdinances 24-07-559 - 07/08/2024 - Amend Ch 22 Fire Prevention Article III-Sec. 22-71-EV PolicySTATE OF GEORGIA COUNTY OF FULTON ORDINANCE J_ 1-0 7-ssq AN ORDINANCE TO AMEND CHAPTER 22 -FIRE PREVENTION AND PROTECTION AND APPENDIX A OF THE MILTON CODE OF ORDINANCES TO ESTABLISH ARTICLE Ill -FIRE CODE, DIVISON 2.-REGULATIONS, CREATE SEC. 22-71 ELECTRIC VEHICLE (EV) CHARGING STATION, AND APPROVE ASSOCIATED FEES BE IT ORDAINED by the City Council of the City of Milton , GA while in a regularly called council meeting on July 08 , 2024 , at 6:00 p.m. as follows : SECTION 1. That the amendment of Chapter 22 -Fire Prevention and Protection and Appendix A of the Milton Code of Ordinances to establish Article Ill Fire Code, Division 2.-Regulations , Create Sec. 22-71 Electric Vehicle (EV) Charging Station , and Approve Associated Fees is hereby adopted and approved ; and is attached hereto as if fully set forth herein , and; SECTION 2. All ordinances, parts of ordinances, or regulations in conflict herewith are repealed . SECTION 3. That this Ordinance shall become effective upon its adoption. REGULATIONS Secs. 22-71-Electric Vehicle (EV) Charging Station. (a) All new and existing EV charging stations located in public, private, or commercial parking facilities, with the exception of single-family residences which are specifically excluded from coverage under this ordinance, shall be equipped with an NFPA 701 Standard Compliant lithium-ion vehicle fire blanket. (b)The vehicle fire blanket(s) shall be stored in a weatherproof storage box and labeled, "VEHICLE FIRE BLANKET-FOR FIRE DEPARTMENT USE ONLY". (c) The mounting location of the fire blanket box shall be determined by the Fire Marshal. (d)The fire blanket box shall be secured with a specific keyed padlock which is accessible by the fire department, and not the general public, as designated by the Fire Marshal. (e) Vehicle fire blankets.are subject to expiration, as per manufacturer specifications, and must be replaced as indicated. (f) All public, private, and commercial parking facilities which have one ( 1) or more EV charging stations will be subject to inspection annually by Fire Inspectors to ensure compliance with this ordinance. (g) The number of EV charging parking spaces determines the number of required vehicle fire blankets. ( 1) For one ( 1) EV charging parking space, one ( 1) vehicle fire blanket is required. (2) For two to ten (2-10) EV charging parking spaces, two (2) vehicle fire blankets are required. (3) For eleven to fifteen ( 11-15) EV charging parking spaces, three (3) vehicle fire blankets are required. (4) For every additional five (5) EV charging parking spaces beyond fifteen ( 15) charging parking spaces, an additional vehicle fire blanket is required. (i) Any applicable owner or leaseholder covered by this section shall be subject to the penalties set forth in all sections of the Code for any violation of this section, provided that the maximum fine for a conviction for a violation of this section shall be $1,000.00.
