AN ORDINANCE FOR A USE PERMIT FOR An "ARTIST STUDIO" (8.5.14.C) LOCATED AT
900 PLEASANT HOLLOW TRAIL
BE IT ORDAINED by the City Council for the City of Milton, Georgia while in regular
session on October 7, 2024, at 6:00 p.m. as follows :
SECTION 1. That the Zoning Ordinance of the City of Mi lton be amended , so
that the following property located at 900 Pleasant Hollow Trail consisting of a total
of approximately 3.320 acres as described in the legal description attached hereto
as Exhibit "A", be approved for a Use Permit for an Artist Studio subject to the
Conditions of Approval described in Exhibit "B"; and
SECTION 2. That the Artist Studio listed in the attached conditions of the
approval, be approved under the provisions in Article 5.1 of the Unified
Development Code of the City of Milton; and
SECTION 3. That the Concurrent Va riance (VC24 -02) be approved as
described in Exhibit "C"; and
SECTION 4. That the property shall be developed in compliance with the
Conditions of Approva l as described as attached; provided that no uses or
conditions hereby approved (including any site plan) shall au t horize the violation of
any district regulations or other zoning regu lations other than as authorized by th e
Concurrent Variance as described in Exhib it "C " approved hereby; and
SECTION 5. That all ordinances or part of ordinances in conflict with the
terms of this ordinance are hereby repealed ; and
SECTION 6. This Ordinance sha ll become effecti ve upon adoption by the
Mayor and City Council and the signature of approval of t he Mayor.

EXHIBIT "B"
CONDITIONS OF APPROVAL
Property located at 900 Pleasant Hollow Trail for a Use Permit for an Artist Studio
(8.5.14.C) subject to the owner's agreement to the following enumerated
conditions. Where these conditions conflict with the stipulations and offerings
contained in the Letter of Intent, these conditions shall supersede unless specifically
stipulated by the Mayor and City Council.
l) To the owner's agreement to restrict the use of the subject property as
follows:
a) Restrict the use of the subject property to an Artist Studio for books,
leather goods, paper goods, jewelry, pottery, painting, sewn goods or
other similar arts as approved by the Community Development
Director.
b) Restrict the hours of operation to Monday -Friday from 9 a.m. to 6:00
p.m.
c) Restrict the hours of delivery to Monday-Friday from 8:00 a.m. to 6:00
p.m.
d) Restrict the number of employees to 4.
e) No members of the public or walk-in retail sales may occur on the
subject property.
f) No signage shall be permitted on the property for the art studio.
2) To the owner's agreement to abide by the following:
a) Substantial compliance with the Site Plan submitted to the Community
Development Department on June 13, 2024, and whereby the exact
layout of the project may contain minor deviations approved by the
Community Development Director provided the deviations remain
consistent with the purpose and intent of the Council's approval of the
Use Permit. Notwithstanding the contents of the site plan, the project
must meet or exceed the requirements of the Zoning Ordinance, all
other applicable city ordinances, and these conditions. The site plan
may be revised with the approval of the Community Development
Director in order to comply with city codes and zoning conditions.
Unless otherwise noted herein, compliance with all conditions shall be
in place prior to the issuance of the first Certificate of Occupancy.
3) To the owner's agreement to abide by the following requirements, dedication,
and improvements:
a) That all construction complies with the Chief Building Official and Fire
Marshal requirements for the structure.

APPROVED CONCURRENT VARIANCE (VC24-02)
(l) To allow the existing accessory structure to remain in front of the primary
residential structure (VC24-02, Part 1)
(2) To allow the existing accessory structure to remain as is, without being designed
in accordance with the predominant commercial building types. (VC24-02, Part
2)
(3) To allow the existing accessory structure to remain as is, without having a ratio of
openings to solids from 30% to 50%. (VC24-02, Part 3)
(4) To allow the existing accessory structure to remain as is, without the existing
accessory structure having the same window arrangement as the side with the
principal entrance. (VC24-02, Part 4)
