BE IT ORDAINED by the City Council of the City of Milton , GA while in a regularly called council meeting on June 2, 2025 , at 6:00 p .m . as follows: SECTION 1. That Articles 2, 6, 7 A, 7B and 9 of the Unified Development Code for the City of Milton, Georgia regarding Stormwater Facilities to Correct references within the above Articles are shown in Exhibit "A ", attached hereto and incorporated as if fully set forth herein; SECTION 2. That all ordinances , parts of ordinances, and regulations in conflict herewith are repealed ; and SECTION 3. That this Ordinance shall become effective upon its adoption. ORDAINED this the 2nd day of June 2025. Attest : EXHIBIT "A " Sec. 10.2 Developme nt Utilities I ARTICI.£ 10 ST REET S AND IMPROVEMENTS SK.10.2.4. Sto rmwa te r Fadlltles a. Identify the surface wate r runoff quantity, quality and rate ; b. Establish runoff management control requirements for t he development; c. Furnish all design calculations for the ma nagement control facil it ies, surf ace wate r conveyance systems (before and after developm ent runoff); and d. Fu rnish design calcula t ions for the volume of storage required. 3. A schedule indicating the t iming fo r planting or mulching for tempora ry or permanent ground cover must be subm itted with these grad ing and dra inage plans. 4. Eros ion con t rol devices mu st be installed before starting grad ing and construction ; the engineer must state thi s requirement on the enginee ri ng draw in gs. 5. To ensure full compliance with the approved construction plans, final plat approval will be withheld until "as - bu ilt " draw ings , prepared by a professional engineer or land scape arch itect currently registered in the st at e, ha ve be en subm itted and approved by the Director in accordance with Sec . 12.6.5 (Final Plat Approva l). No occupancy permit will be iss ued until released by the Director. 6 . The owner must maintain the storm drainage facilities during grading and construction , and for 18-months bond durat ion after final plat approval. Maintenance will be construed to include preserving the enclos in g walls or impounding embankment of the detention basin and permanent sedimentat ion pond s and secur ity fences , in good conditions ; ensuring structural soundness , funct ion al adequacy , and freedom from sedime nt of all dra inage structu res ; and rectifyi ng any unforeseen eros ion problems. c. o.t.ntion/Rnention Desip L Genera l a. In stallatio n of proper1y funct ion ing detention fa cili t ies , includi ng outflow control dev ices , is th e respons ibility of the owner. If any contro l devices are damaged or destroyed during grading or constru ct ion , all processes mu st cease until such device s are re sto red to their funct ion ing capabili ty. The owner , t hrou gh app lication for grad ing or construction permits , accepts th e respon si bility of maintenance of th e control device s. b. When serv in g more than three lots, except when all the si ngle-fam ily residential lots are each a min imu m of 3 acre in size , detention pond s, retentio n ponds , and wate r quality features (includ ing all require d access easements , landscap e strips, an d fences) must be loca t ed on a separate parcel where no home can be constructed . This parcel must be owne d an d maintained by a homeowners ' association or the owners of the lots being served by this pond. The parcel must have a minimum of 20· foot-wide con t inuous access to a public or private str eet in a manner tha t allows access an d maintenance of t his parcel. Stormwat r Faciliti s 10-6 required to meet the normal lot standard. 2. Design standards. Above-g round stormwa t er management facilities must mee t the following standards: a. Provide a 20-foot graded access easement. b. Provide 10-foot access easement for main t enance . c. Provide 6-foot-high fence . d. Be located in the least conspicuous area of the site as engineering standards allow. e. Be designed to create a natural look. f. Be surrounded by a mi nimum 10- foot-wide landscape strip planted to buffer standards with evergreen plan t ings exterior to any required fence and /or required access area , except as otherwise approved by the Director under Sec. 10.2.4 .C.2.g immedia t ely below. g. In lie u of Sec. 10.2.4 .C.2.f immediately above, the 10 -foot- wide l andscaped strip is not required to be plan t ed to buffer stan dards when the following stan dards are met: i. The minimum 10 -foot-wide landscape strip is incorporated into a larger open space. ii. The open space containing the stormwa ter facility is designed and stamped by a Landscape Architect licensed in the State . iii. The stormwater feature is designed as formal or natural amenities for the open space. Iv. The stormwater features does not constitute more than 25% of the required open space. 3. Alternative des ig n standards. App l icants are encouraged to carry out innovative deten t ion/retention layouts that are intended to make such faci l i t ies an attractive amenity or focal point to the subdivision . To achieve that, the Director may approve the following alternative design standards in lieu of those in Sec. 10 .2.4.C.l and Sec. 10.2.4.C.2: a. Such alternative design shall provide for an attractive layout and means for detaining, retaining, and /or moving water. b. The design shall follow the natural landforms around the perim ter of t he basin . The basin should be shaped to emu l ate a naturally formed depression . c. Redistributing soils from basin construction to create natural landforms around the perimeter of t he basin is encouraged . These forms shall be located strategically to filter views or redirect and soften the views from residential areas . d. Side slopes of basins must not exceed on foot vertical for every 4- feet hori2-0ntal. Where possible, side slopes should be varied to imitate na t ural conditions . Associated natural landforms should have side slopes that do not exceed one foot vertical for every 3 feet horizontal to accommodate lawn ma i ntenance equipment. Varied slopes will be encouraged . Trees and shrubs shall be grouped in informal patterns to emulate the natural environment. The intent is to soften the views of these basins. 4 . Design guidelines.
