Oficial Meetings are audio recorded. The Work Session of the Mayor and Council of the City of Milton was held on June 14, 2010 at 6:00 PM, Mayor Joe Lockwood presiding. Council Members Present: Councilmember Karen Thurman, Councilmember Julie Zahner Bailey, Councilmember Bill Lusk, Councilmember Burt Hewitt, Councilmember Joe Longoria Councilmember Alan Tart was absent. Mayor Lockwood: • Work Sessions are an informal setting to update Council on business items. • No votes will be taken during these sessions. • There are six (6) items on our Agenda tonight. • Public comment is allowed that is germane to an Agenda Item. • If you wish to speak you are required to fill out a comment card and turn it into the City Clerk staff. • Public comment will be allowed for a total of 10 minutes per agenda item and no more than 2 minutes per person. • Public comment will be heard at the beginning of each Item. • Once the item is called, no other comment cards will be accepted. Interim City Clerk Gordon read Agenda Item #1. 1. Petition for Sewer Access to Bethany Properties (Presented by Tim Enloe) Carol Lane, 14890 East Bluff Rd., Milton, GA: • The property proposed was never included in any of the proposed sewer maps from the City of Milton or Fulton County. • This property was not included in the Crabapple master plan to include sewer. • The property falls in the no sewer area in Milton. • I would appreciate if you uphold the no sewer extension policy that we adopted. Tim Enloe, 13005 and 13075 Bethany Road, Milton, GA: • Tim Enloe presented a video for the petition for sewer access to Bethany properties. • Desires equal treatment. • We want what we paid for in Milton. • We have problems with noise pollution. Mayor Lockwood: • Is this property included in the actual maps that Fulton County believed to be a sewered area? Lynn Tully: • Not to my knowledge, Sir. Mayor Lockwood: • I have been to the Enloe property and I think this would be an extension and it would not be in the boundaries that Fulton County set. I would not support making this a sewer area. 0 1 don't believe having sewer would make your land any more useful. Work Session of the Milton City Council Monday, June 14, 2010 at 6:00 pm Page 2 of 4 Tim Enloe: • I am requesting a sewer extension. • I am here to address the noise issue from the new high school in Milton. • The noise from the school scares my horses and rattles my windows to my home. • There isn't a relaxing time in my home because the noise is so loud. • I would like to find a compromise with the school, noise, and the band. • I don't want to move. Karen Thurman: • The use of the property is the bigger issue for me. • I am assuming that you want sewer so you can put more houses per acre. • What is the reason you are requesting sewer? Tim Enloe: • The bigger issue for me is the noise. • When we have to do a full disclosure, we have to disclose on the list that one of the issues is the noise. • The noise is killing our market if we wanted to sell to someone with horses. • Since we lose on the house because of the noise, I want to compensate with sewer. Karen Thurman: • Lynn, what is the property currently reflected on the land use map? • On the maps that CPAC is putting out, is that area always one unit per acre? Lynn Tully: • It is one unit per acre. • Thus far, yes but they are still in draft. • Currently the zoning is for AG. It does not allow anything more than 1 unit per acre with the exception of senior housing which would require sewer. Mayor Lockwood: • The bottom line is it's the noise from the school. • When I bought my property 16 years ago, it was peaceful. • The community has grown and changed. I can hear 400 from my property and traffic. • I understand where you're coming from. Tim Enloe: • We were here first. • We want something to be done with the B.O.E instead of the Council saying their hands are tied. • The article that Jason wrote about the school stated that they would have all band practices inside. • What are you going to do with the B.O.E? Joe Longoria: • It seems that you are implying that the council is not taking action. • We do not know what you want us to do. • Your presentation makes assumptions, asking to be treated equally. That implies that we are treating you unfairly. • You are implying that we are not doing anything to help. • The B.O.E looks at the City of Milton the same way it looks at individual citizens. Tim Enloe: • Please speak with the B.O.E about the noise. • Let them know they are making people miserable with the noise. Mayor Lockwood: • I do believe they have made some adjustments and moved some speakers. Bill Lusk: • I take it the main point of your presentation was about the noise, not the sewer. • In the past, you have had some dialogue with Ron Tesch, but there has been a change in principals. Have you spoken with him? Tim Enloe: • I was going to wait until the new principal gets his feet wet. Karen Thurman: • I'd be happy to meet with the new principal with Mayor Lockwood. Julie Zahner Bailey: • I think it's important to separate the noise issue from the request of sewer extension. mono • Before we close this item and go on, I think it's critical to make that distinction. • I would be happy to meet with the new principal as well. Owma • By law, any noise problems need to go through the police. Tim Enloe: • We did call the police at one point but I wouldn't do it again. • I wouldn't ask the police to come over and be pulled from taking care of Milton to deal with something the B.O.E should be taking care of. Mayor Lockwood: • We will do all we can and talk to the Board of Education. Interim City Clerk Gordon read Agenda Item #2. 2. Reallocation of 1.5M in Federal Aid Funding (Presented by Carter Lucas, Public Works Director) Carter Lucas: • There was an overspending of the account given for Interstate 400 fund in 1988. • We were asked to allocate funds such as the Bethany Road intersection at Providence Road and Freemanville Road intersections were dropped from overall funding to make up for the overage on that account. • Each City would receive 1.5M back from the funding that we had gave up. • We need to allocate those funds to where they would be appropriately used. • The dropped projects were the Bethany Road intersection at Providence Road and the Freemanville rr.. Road at Providence Road from the overall funding to make up our share of the overage on that account. • Allow the department to hold the funds. • 1 would like the roundabout to be covered completely by federal funding. Discussion of Projects for the Use of Marta Offset Funds (Presented by Carter Lucas, Public Works Director) Carter Lucas: • 6.25M was divided between North Fulton Cities. • Back in January, these projects were approved by you and Marta and have been included in the ARC Tips program. • Milton received $613,000. • We are requesting three projects that would account for $380,000 dollars. • $233,000 would be allocated for future projects. • Ready to move forward on the extension of streetlights along Deerfield, $190,000. • Pavement repairs and resurfacing Webb Road between Deerfield and Morris. • ADA upgrades at all intersections along Morris over to Cogburn. Interim City Clerk Gordon read Agenda Item 44. 4. Discussion of An Ordinance Regulating the Location, Placement and Leasing of Wireless Telecommunications Facilities. (Presented by Lynn Tully, Community Development Director) Lynn Tully: • Georgia Regulatory Tax Services has made changes to the ordinance. • The allowance for new options for siding of cell towers. • More detailed review of the application and requirements for that application. • Additional outside review of the application. • A local operating license for all cell towers and annual maintenance and inspection. • Additional aesthetic considerations in the approvals. • This is what the council had requested from staff. • This will satisfy all of our legal requirements. • This will not have any effect on the past applications, however, there have been no new applications filed.
