ROLL CALL City Clerk Marchiafava called the roll. Councilmembers Present: Councilmember Rick Mohrig, Councilmember Julie Zahner Bailey, Councilmember Tina D'Aversa-Williams. City Clerk Marchiafava asked that the record reflect that Councilmember Thurman was not present at this time. Councilmember Thurman arrived a few minutes later after public comment. PLEDGE OF ALLEGIANCE Mayor Lockwood led the Pledge of Allegiance. APPROVAL OF THE MEETING AGENDA City Clerk Marchiafava stated that the first item is approval of the Meeting Agenda, which is the second reading a an ordinance annexing 12450 Arnold Mill Road property, and an ordinance annexing 12500 Arnold Mill Road property. She asked if there was motion to approve the agenda. Motion and Vote: Councilmember D'Aversa-Williams moved to approve the Meeting Agenda. Councilmember ,..�. Zahner Bailey seconded the motion. There was no Council discussion. The motion passed unanimously. PUBLIC COMMENT City Clerk Marchiafava asked if anyone would like to address the Council during public comment. There were no comments. UNFINISHED BUSINESS Approval of an Ordinance Annexing 12450 Arnold Mill Road Property. (Second Reading) Ordinance No. 06-11-49 City Clerk Marchiafava stated that the next item is approval of an Ordinance Annexing 12450 Arnold Mill Road property. She asked if there was any public comment. There was none. Motion and Vote: Councilmember Zahner Bailey moved to approve an Ordinance Annexing 12450 Arnold Mill Road Property. Councilmember D'Aversa-Williams seconded the motion. There was no Council discussion. The motion passed unanimously. Approval of an Ordinance Annexing 12500 Arnold Mill Road Property. (Second Reading) Ordinance No. 06-11-50 City Clerk Marchiafava stated that the next item is approval of an Ordinance annexing 12500 Arnold Mill Road property. Special Called Meeting of the City of Milton Tuesday, November 28,2006,9:00 AM Pace 2 of 11 MAYOR AND COUNCIL REPORTS Councilmember Zahner Bailey stated that for the record she wanted to remind everyone that there is a meeting with aw Georgia Transmission Corporation tomorrow morning at 9:30 AM at the Thompson site and anyone who like to attend is welcomed to. She will confirm later that day if the meeting will be with their Landscape Architect and Project Manager. STAFF REPORTS City Attorney Scott state that he and Councilmember Thurman attended the Roswell City Council Meeting yesterday that there are two developments that he needed to report: 1. The City of Roswell has moved the second reading of Cagle/Etris annexation, which directly conflicts with Milton's Arnold Mill sixty percent annexation being read that night. He continued to say that there are two problems with them doing that: a. Under the statute Roswell had to advertise it as that night for two weeks immediately proceeding. b. Roswell had to provide written notice to the applicants fourteen days prior of that meeting date and time. He stated that Roswell has not complied with those aspects of the statute. Roswell knows that they have a problem because they took out two advertisements, one in the Atlanta Journal Constitution and one in the Neighbor, but they could not have been for two weeks. 2. The City of Roswell sent a letter out to everyone in the affected properties to let them know that the public hearing had been changed. a .,. The statute does not allow Roswell to give notice by letter; it requires notice be made by newspaper. If the Legislation had intended for notice to be made by letter they would have said so. He stated that in his opinion Roswell is racing to get it done before Milton can annex their properties. City Attorney Scott stated that the Council needed to decide whether they wanted him to begin to do something about the issue at hand from a legal perspective. He continued to say that as of December 1 there would be two cities that have annexed the same property. The people in those properties are not going to know who to go to for building and related permitting. The police and fire departments from Milton and Roswell are both going to service that same area. From his prospective, he believed that he can make a very good case that there is immediate and reparable harm that would justify the City filing a complaint and getting a restraining order or injunction. Councilmember D'Aversa-Williams asked if it would be appropriate for the City to attend the Roswell meeting that night and make a public comment. Milton needs to make Roswell extremely aware that they are causing a challenge that need not be caused and they should cease now passing those ordinances. Milton should contact the homeowners to have them attend the Roswell meeting. Councilmember Thurman stated that Roswell knows that they have a problem from another perspective in that they have gone ahead with a hundred percent annexation of Hayden Hall and properties on Ebenezer. Roswell recognizes that there is no need for them to do a hundred percent annexation. Roswell went into Executive Session to discuss pending litigation, which might be on that subject. She wanted to make sure that by Roswell doing their hundred percent annexations it does not invalidate Milton's ordinance, because it includes Hayden Hall. She would like to post another public notice to go into the paper tomorrow for all the properties not included in Roswell's one hundred percent, in case both City's ordinances are deemed invalid. ftw City Attorney Scott responded that he will get City Clerk Marchiafava the land lot numbers and property description. He can get the City information by the December 7t' meeting for the first reading. The City needs to advertise for the December 22 Public Hearing. Special Called Meeting of the City of Milton Tuesday, November 28,2006,9:00 AM Page 3 of 11 Councilmember Thurman believed that the City should place an advertisement for the Public Hearing that same week, if possible. She added that the City is not adding any new properties to the ordinance, we are just removing some. am Councilmember Mohrig agreed with Councilmember Thurman and asked what are the fifteen days. City Attorney Scott answers that the fifteen days are from the day that the City validated the petitions. He believed that the City has already validated the petitions on the November 14"'. Councilmember Thurman asked what are the earliest two days that the City can advertise for the Public Hearing. City Attorney Scott answered that the City only had to advertise for two weeks prior to the Public Hearing. If the City can get the advertisement in for that week and the following week, they would be able to hold the Public Hearing on December 7. Councilmember Zahner Bailey stated that the City can make the deadline for the Milton Herald that week if the City committed to them by noon that day; then get the advertisement to them by the end of the day. Councilmember Thurman stated that another reason why Roswell's ordinance may be invalidated is that they included to parcels that Milton had just annexed that night. She continued by stating that the City needed to make certain that they include only property that they can legally include so that it does not raise in questions. Mayor Lockwood asked if by both cities annexing the same properties it will leave the owners in limbo. He continued .., by asking does the City need to sit down with Roswell and explain to them that the owner asked specifically to be annexed into Milton. City Attorney Scott answered that he had considered that solution and would be glad to sit down with David Davidson [City Attorney for Roswell], but the problem was that Mayor Jere Wood would not listen to anyone's advice. He continued that short of a judge signing a consent order forcing the cities to the table, neither city will be able to draw the lines the way that they want them because they have to have sixty percent or one hundred percent. He asked how the City wanted him to proceed because it came down to how they Council wanted to spend their revenue. He suggested that the City's quickest way to get a resolution is to file papers to get a hearing on a temporary restraining order at which point a judge will sit the cities down and make them come to an agreement. When the judge signs the order then the lines are legally drawn. Mayor Lockwood stated that if the City proceeded with that suggestion than Milton and Roswell will not be negotiating in a friendly way. He suggested that City Attorney Scott talk to Roswell's City Attorney David Davidson and find out what the most reasonable route is to a resolution. If both attorneys are on the same page, then maybe he and Mayor Wood can meet. Several Councilmembers agreed with the Mayor. City Attorney Scott stated that even if they had agreed on lines, neither city has the power to set those lines without judicial or legislative intervention. He continued that the cities can file a joint motion or petition to the court to ask them to validate the lines that are agreed with. Councilmember Zahner Bailey asked if the City can draft a friendly letter to Mayor Wood stating that Milton would like to meet with him to discuss the issues at hand. If he agrees to meet, then send out a follow-up letter thanking him Ofor meeting with Milton. That way Milton has made every attempt to deal with the problem in an up front communicative manner. That OEM way the City will not be perceived as pursuing the annexation in an antagonistic manner. aw Councilmember Thurman stated that these disputes typically happen between counties and cities because cities are not usually formed within three miles of one another. For that reason, she cannot find case law with cities overlapping each other. Councilmember Mohrig asked if there were owners in the Cagle/Etris area that have signed with Milton, but the action by Roswell will place them in Roswell. Mayor Lockwood stated that is the reason why Milton is taking action to prevent that from happening. The City's argument to Roswell is that these owners want to be in Milton not in Roswell. Councilmember Thurman states that the only parcels the City is interested in are the ones that contacted us and the Cagle Road petitioners that signed with Milton and Roswell, but really want to be in Milton. The only reason why they signed with Roswell is because they were told that they had to and that there was no way for them to be in Milton. All the petitioners wrote letters to Roswell withdrawing their signatures except for one that never signed with them. There is one petitioner that went so far as changing the deed on the house so that is it jointly owned because he was not originally on it. He is over seventy years old and he wants the exemption that Milton offers. She continued that the only other owners that want to be in Milton, but are not included are Ralph Anges, who is owner the cemetery, and the George Baker Complex. The reason why the City wants the George Baker Complex is because it will give the City lighted fields and parkland, and the YMCA who wants to sign with the City. . She continued that Roswell is contacting these owners five times a day and Mayor Wood has broken down gates to leave things at the door. Milton has not gone to that extent. ., Councilmember Mohrig added that when the City has contacted the owners it has not to been to coerce them into signing with the City, but rather to inform them of what the City offers. Mayor Lockwood stated that Roswell is speaking negatively about Milton, which is confusing the residents. Ultimately, which ever route the City takes will end up in the same situation, so there needs to be a give and take. City Attorney Scott asked what the Council wants him to do in terms of preparing papers to file on Thursday if that is what they chose to do. Councilmember Mohrig clarified that from the meeting that City Attorney Scott attended the previous night, Roswell intends to annex the area that Milton will be officially annexing on Thursday by the sixty percent rule which includes Cagle Road. Councilmember Zahner Bailey asked that besides the call to Mayor Wood from Mayor Lockwood does the City need to prepare a letter to reflect their conversation. Councilmember Thurman stated that the previous night Mayor Wood stated that he does not know what Milton has annexed. Councilmember Zahner Bailey replied that the City needs to make him aware of that. No" City Clerk Marchiafava stated that she has sent him the ordinances annexed and she will fax him the action minutes on Milton's annexations. She added that the information is available on the City's website. flare Councilmember Mohrig asked where on the website is the information because he cannot find updated maps. Councilmember Thurman asked if Ordinance #32 was Mr. Tritt's property. Special Called Meeting of the City of Milton Tuesday, November 28, 2006, 9:00 AM Page 5 of 11 City Clerk Marchiafava answered yes. +frn+ City Attorney Scott stated that Mr. Tritt attended Roswell's meeting the previous night and explained to Roswell that he has already been annexed into Milton. Councilmember D'Aversa-Williams asked what Roswell's response to Mr. Tritt was. City Attorney Scott answered that Roswell said absolutely nothing. Councilmember D'Aversa-Williams stated that she was the first one to say that the City needed to be congenial so that we can have very positive negotiations with Roswell. However, Roswell is the city that is starting the issues. She believed that is worth the Mayor giving Mayor Wood a call and it is absolutely necessary to send a letter and do the research into filing a complaint. They agree unanimously that it is very important to the City to annex those properties. Councilmember Thurman stated that she would have never worked so hard if the owners did not really want to be incorporated into Milton. That is what has made it all worth it for her. Councilmember D'Aversa-Williams stated that it is appalling how an established long time city council and mayor can treat their residents that way. Milton has listened so openly to people and has been so nice in their attempts to contact people. Councilmember Thurman stated Mayor Wood previously stated that he will not contact anyone who has signed with Milton, but Roswell has contacted people over and over again that have signed with Milton. Councilmember Mohrig added that a resident on Ebenezer Road told him a Roswell employee asked her "why are you people on Ebenezer Road so difficult." Councilmember Mohrig believed the only reason why Roswell thought they were difficult is because they want to be in Milton. Councilmember Zahner Bailey asked if the letter will be drafted that day and will it include an update about what has been done within Milton to date. City Attorney Scott answered that it will include all the properties involved and which are in conflict. Mayor Lockwood stated that he wanted the letter to positive and include those property owners who have come to Milton asking to be annexed with the City. City Attorney Scott stated at the end of the letter he will put that the City is contemplating legal action because judicial intervention may be necessary, though the City is open to drawing lines that people are agreeable to. Councilmember Mohrig suggested saying residents not people because it comes down to what the residents want - not negotiations between the Cities. Councilmember Thurman stated that realistically the City cannot do anything until that Thursday because they have not officially annexed it. Councilmember Zahner Bailey asked if the City should state in the letter what they have done, but also what their WON intentions are for Thursday. Also, she asked should it be sent certified mail and faxed so that there is no question that it is received. Councilmember Mohrig stated that their intentions have already been made public in the posted public notices. Councilmember Thurman stated that she needs to meet with the Mayor before he meets with Mayor Wood, to give him all the background. Special Called Meeting of the City of Milton Tuesday, November 28,2006,9:00 AM Page 6 of 11 Councilmember Zahner Bailey suggested that the letter be carbon copied to Roswell City Council so that they are all aware of Milton's intent. Councilmember Mohrig stated that anything that goes needs to be positive because it is a reflection upon the City. The City was misrepresented in the way the article was written in the Atlanta Journal Constitution because it looked like the City was doing something deceitful. What the City did was a one hundred percent annexation and only took people who wanted to be in the City. City Attorney Scott commented that the article stated Milton never had a public hearing on the annexation, so he emailed him and told him that the City did have a public hearing. Councilmember Mohrig stated that the City has to make it clear to Joan Durbin from the Neighbor that it was a one hundred percent annexation and the only reason the meeting was at 12:01 AM is because it was a holiday weekend and people were leaving to go out of town so they could not convene later in the day. Councilmember Zahner Bailey asked if the City could construct a press release that outlines the facts as they were just discussed and send them to all the newspapers, Paul Kaplin, Hatcher Hurd, Doug Nurse, and Joan Durbin so that there is a consistent message. She believed that the City does not need to be on the defensive, but on the offensive. All Councilmembers concurred. Councilmember Thurman stated that Roswell has sent out letters to everyone even though the annexations were not complete. The City needs to send out welcome letters to their residents including annexed owners. Councilmember Mohrig concurred and added that we are being proactive so that there is no confusion. Councilmember Thurman stated that some of owners on the sixty percent annexation are concerned that both Milton and Roswell annexation will be deemed invalid and that the new annexation will not be completed prior to November 30th and they will be subject to Fulton County taxes. Those same owners want to be annexed under one hundred percent. Councilmember Thurman stated that she did not know about the owners in Sweet Apple and she was not sure if the City should annex them at one hundred percent. Moratorium and Continuation of law of Fulton County City Attorney Scott stated that he and City Manager Bovos have discussed implementing a moratorium on zoning from December 1 to December 21 because there is a constitutional provision that counties cannot provide zoning or related services inside cities. The City Charter may be in violation of the provision which makes the City vulnerable, so he strongly suggested that the City create a moratorium. The City would need to have a first reading on November 30`h and the second reading the December 1. He continued by stating that the City also needs to consider renewing the ordinance on the continuation law of Fulton County. Councilmember Mohrig stated his concern about the indeterminate moratorium is opening up the City to legal actions. Councilmember Thurman stated that she does not want it to come off as a moratorium, but rather as a stop gap measurer. City Manager Bovos asked if City Attorney Scott can walk everyone through what a moratorium is since the City cannot legally accept any zoning or permitting applications. Special Called Meeting of the City of Milton Tuesday, November 28,2006,9:00 AM Page 7 of 11 City Attorney Scott answered that the City cannot legally accept them because the Charter provides that the County has the power to do that until the City tells the County that they are taking it over. The problem is that the constitutional provision says that the County cannot provide that function within a city. If someone is successful in challenging the hitt constitutionality of that provision in the Charter, then it can be over turned. City Attorney Scott stated that Johns Creek is doing it as well. Councilmember Thurman asked what the down sides of the moratorium were. City Attorney Scott answered that maybe people will be upset and the only way to avoid that is to explain why. He continued that the City has a de facto moratorium in effect already; it cannot hurt to have a legal moratorium in effect for only the same amount of time. He said he will prepare the ordinance for December 1 S` at 9:00 A.M. It was said that the first reading will be on Thursday, November 30'' and the second reading December 1S`. The Mayor would not be able to attend the December 1St meeting. Councilmember Zahner Bailey asked if the Council can elect a temporary Mayor Pro Tem on December 1S` while the Mayor is out of town. Councilmember D'Aversa-Williams answered that the Charter does not allow it until the full Council has to be seated. Councilmember Zahner Bailey asked what will happen in an emergency situation. City Attorney Scott suggested selecting an emergency temporary Mayor Pro Tem just for that one day. City Manager Bovos explained that the Mayor has to be in the City in order to be part of the meeting therefore he cannot be on a conference call with them. rte. He continued by asking if the moratorium had to be enacted by ordinance. City Attorney Scott answered yes and it has to be done on December 0 because that is when the City has official zoning power. City Manager Bovos stated that the Council can adopt the ordinance on November 30th. City Attorney Scott replied that it would open the City up to the challenge that they did not have official zoning powers to enact a moratorium until December 1 S` Councilmember Mohrig asked if the Council can adopt an ordinance on November 30th to be effective for December I St City Attorney Scott answered that it will still open the City up to the challenge that the City does not have the zoning power until November. Councilmember Thurman asked if the City can adopt a resolution on Friday and then adopt it again on Monday, December 1'. City Attorney Scott answered yes, the Council does not need to adopt an ordinance they can adopt a resolution. Mayor Lockwood asked City Attorney Scott to do the research to see if the City has any real exposures if they adopt a Om resolution on the November 30th effective December 1S` Councilmember Zahner Bailey and City Attorney Scott both answered yes there are exposures. She added that the question is how does the City legally hold a meeting. Councilmember Zahner Bailey stated that if there is not a mechanism the City should adopt a temporary mechanism on November 30"' to allow for the City to hold a meeting on December V. Mayor Lockwood should put forward a resolution that mitigates whatever the City needs to do to conduct a meeting on December I". City Attorney Scott suggested that the Council elect something like a temporary chair. Councilmember Zahner Bailey stated that the Council will have a 10 o'clock meeting on November 30th and determine how the City can hold the meeting on December 0 and pass a resolution on the 30`x' to readopt it on the 15` potentially holding a meeting on the next Monday when Mayor Lockwood will preside. Councilmember Thurman asked if the City has to advertise for all the meetings. Continued Annexation Discussion Councilmember Mohrig answered yes because they are all public meetings. He then asked how many parcels does Councilmember Thurman have and does that invalidate the percentage for the sixty percent. City Attorney Scott answered that he does not believe it does it just over laps. As the City creates another sixty percent annexation for a stop gap measurer the City will exclude property that Roswell has taken it will justify the sixty percent. Councilmember Thurman added that the previous night she had calculated the percentages without the properties that Roswell had annexed under their hundred percent. The properties that had withdrawn their signatures with Milton and • the City were well over sixty percent without there being an issue. Councilmember Mohrig asked would that be true if the City did a hundred percent annexation those properties. Councilmember Thurman answered that one of the properties that the City is looking into annexing had no voter because it is a business. City Manager Bovos asked if the Council would like meet the next day to annex that one property. Councilmember Zahner Bailey asked if the Council will have a quorum if they were to meet the following day. Councilmember Mohrig asked what time is that meeting. Councilmember Zahner Bailey asked if it could be before 9:30 AM so that she could make the GTC meeting at that time. City Manager Bovos answered no because the City had to give twenty four hours notice. Councilmember Zahner Bailey asked if it could be at night. City Manager Bovos answered yes. He clarified that the Council will meet November 29`'' at 6:00 PM at Fulton County Fire Station #18 Thursday at 10:00 AM at Birmingham Methodist, Friday at 9:00 AM at Fulton County Fire Station #18, and December 4th at 9:00 AM at Fulton County Fire Station #18. on" He added that he had to confirm all locations. 600 Councilmember Zahner Bailey asked for confirmation to request that the affected property owners to attend the Roswell meeting that night. Councilmember Thurman answered yes they asked the previous night. Special Called Meeting of the City of Milton Tuesday, November 28, 2006, 9:00 AM Page 9 of 11 '^ Councilmember Zahner Bailey asked if the City should ask additional community members to be there also. +O City Attorney Scott answered it would be a good idea, but it would probably not make any difference to Roswell. Councilmember Thurman added that the community members are the same people who have been going back and forth on who they will sign with, so it may be better not to bother them. Councilmember Zahner Bailey asked if the City should draft a letter to affirm for all of the City residents what their Mayor and Council has done for them to secure their request to be in the City of Milton; so that they have the data directly from the City not from the media. City Attorney Scott asked Councilmember Zahner Bailey if she was planning on sending the letter to people who had pending annexation or who have already annexed. Councilmember Zahner Bailey answered those residents that have been annexed. Councilmember Mohrig added the City should send a welcome letter to both to include those pending annexation and already annexed. Councilmember Zahner Bailey stated that the letter should affirm and confirm what the City is doing and planning on doing. It should be about communication because that is the most important thing. Councilmember Mohrig stated that the City is just starting and now is when there are so many questions and on% misinformation flooding around that the City. This needs to be clarified. Once the City gets established people will be used to the methods of communication. W" Councilmember Zahner Bailey added that she hopes the City is proactive and positive in communication from that day forward. Councilmember Thurman stated that the City will do another ordinance to include the properties that Roswell has not annexed that were included in the City's sixty percent. The City would have annexed some properties three times. Councilmember Mohrig stated that if the properties are not annexed by November 30th, then the City will lose the taxes for next year to Fulton County. That is why it is so important to get the annexations done that week. Councilmember Zahner Bailey asked if there is any risk that the City will not have everything in place on the 21" of December that will require the moratorium to be any longer. City Attorney Scott answered that he does not think so; the City will have the zoning ordinance ready for the first reading on the 7th. Councilmember Zahner Bailey asked what will be the necessary communication on that document. City Manager Bovos answered that the City will do a press release. City Attorney Scott stated that the City does not need to make any changes to the advertisement because it is just "am portions to the land lots that were already included in the properties. The City needs only to change the dates. Councilmember Thurman asked if the City wants the advertisement going in the dates they currently have. Um Councilmember Mohrig stated that the City officials will talk throughout that day to see if the City has more hundred percent annexations. City Manager comments rrrw City Manager Bovos stated that from a staff perspective he certainly applauds the work that the Council has done. His goal is not to have that type of non -planned process that gets deployed from the City. He is worried that there has not been a real master plan, although he realizes that the City was forced into the position they are in. He added that it is not normal for him as the City Manager to have meetings everyday and not have contingences planned out in a overall master plan on how the City gets from a to z. It will not be staff's desire to continue to operate that way. Councilmember Zahner Bailey stated that City Manager Bovos' comments are well noted and understood and that the City should outline everything that they discussed that morning because that is their master plan. City Manager Bovos stated that he will outline everything in an email when he gets back the office. Councilmember Thurman stated that she believes when the ordinances get passed the City will be done. City Manager Bovos stated that he does not want anyone take his comments negatively. Councilmember Mohrig stated that the Council knows that from the way City Manager Bovos operates and from what they have seen already that that is not the way he would intend to proceed. City Manager Bovos stated that the good thing about it is the City can blame it on experience that they have never had ." before. City Attorney Scott stated that chances are the City will never have to do annexations again. Councilmember Zahner Bailey asked legally do property owners in a different county have a legal mechanism. Councilmember Mohrig answered that the property owners have to pay county taxes. Councilmember Thurman stated that there are subdivisions that are divided between Fulton and Cherokee Counties. Retreat Update Councilmember Zahner Bailey asked if there was an update on the retreat. City Manager Bovos answered that he was not sure but he thought the retreat will be during the week. There is no confirmation on dates, but it may be the last week of January. Councilmember Thurman asked how long will it be. City Manager Bovos answered two nights and three days. Councilmember Zahner Bailey asked when the Council will know when it is. City Manager Bovos explained that they had Councilmembers coming in and the GMA Mayors Day Conference to plan around.
