FULTON COUNTY
ORDINANCE ANNEXING
HIGHWAY 9 PROPERTIES
The Council of the City of Milton hereby ordains while in special session on the 301h
day of November, 2006 at 10:00 a.m. as follows:
SECTION 1: Under the provisions of Article 3, Chapter 36 of the O.C.G.A. § 36-36-21,
the City of Milton may, upon petition of not less than one hundred per cent (100%) of the land
area by acreage included in such application, take action to annex such property; and
SECTION 2: The City has received and verified a petition for annexation from the
landowners and electors residing in and/or owning property located in Land Lots 1123 and 1124
of the Second District, Second Section of Fulton County, Georgia, more particularly described in
legal description attached hereto as Exhibit "A" and incorporated herein by reference. Total
acreage is 30.32 acres.
SECTION 3: The City Council has determined that the annexation of said property is in
the best interests of the City and the subject property
SECTION 4: The petition by the landowners and electors for annexation of the
Highway 9 properties is hereby accepted and the properties are hereby annexed into the City of
Milton and zoning shall move forward in accordance with O.C.G.A. Article 3, Chapter 36, Title
36.

HIGHWAY 9 PROPERTIES LEGAL DESCRIPTION
ALL THAT TRACT OR PARCELS OF LAND lying and being in Land Lots 1123 and 1124 of
the Second District, Second Section, Fulton County, Georgia, more particularly described as
follows:
To reach the True Point of Beginning, commence at the corner common to Land
Lots 1123, 1124, 1181 and 1182, thence proceeding along the line common to
Land Lots 1123 and 1124 North 02 degrees 02 minutes 59 seconds West 304.59
feet to a point being located at the intersection of said land lot line with the
northerly point of the Winthrope Chase Development as set forth in Plat Book
206, page 121 Fulton County, Georgia real estate records, said point being the
TRUE POINT OF BEGINNING; thence departing said land lot line running
along the said Winthrope Chase Development the following courses and
distances: South 88 degrees 21 minutes 59 seconds West 489.40 feet; North 11
degrees 33 minutes 40 seconds 85.02 feet; North 05 degrees 06 minutes 36
seconds West 119.52 feet; North 01 degree 33 minutes 19 seconds 247.21 feet to
a point located on the southeasterly right-of-way of Georgia Highway 9 (an 80 -
foot right of way); thence leaving the line of said Winthrope Chase Development
proceeding along said right-of-way of Georgia Highway 9 the following course
and distances: North 67 degrees 38 minutes 31 seconds East 4.24 feet; North 70
degrees 17 minutes 03 seconds East 88.85 feet; North 73 degrees 41 minutes 03
seconds East 107.06 feet; North 73 degrees 20 minutes 02 seconds East 43.00 feet
to a point located at the intersection of said right of way with the northwest corner
of that certain parcel of land set forth in that deed from Winfred E. Day to Sun
Hui Mun, dated May 26, 2006, recorded in Deed Book 42676, page 157, Fulton
County, Georgia real estate records; thence proceeding northeasterly along said
right of way to a %2 inch rebar located at the northeast corner of that certain parcel
on land set forth in that certain deed from Wendell T. Landrum and Gloria
Landrum to Sun Hui Mun, dated May 26, 2006, recorded in Deed Book 42676,
page 159, Fulton County, Georgia real estate records; thence continuing
northeasterly along said right of way line the following courses and distances:
North 74 degrees 40 minutes 01 seconds East 22.17 feet; North 74 degrees 54
minutes 08 seconds East 233.58 feet; northeasterly along the arc of a curve having
a radius of 4119.73 feet, said arc being subtended by a chord bearing North 75
degrees 55 minutes 16 seconds East and having a chord length of 184.35 feet, an
arc distance of 184.36 feet; northeasterly along the arc of a curve having a radius
of 2055.17 feet, said arc being subtended by a chord bearing North 79 degrees 09
minutes 28 seconds East and having a chord length of 163.75 feet, an arc distance
of 163.79 feet; northeasterly along the arc of a curve having a radius of 2467.27
feet, said arc being subtended by a chord bearing North 82 degrees 37 minutes 17
seconds East and having a chord length of 212.72 feet, an arc distance of 212.72
feet to a one-half inch rebar found, said rebar being located at the intersection of

said right of way with the northwest corner of that certain parcel of land set forth
in that deed to Riley Terrace, LLC recorded in Deed Book 35154, page 594,
Fulton County, Georgia real estate records; proceeding thence along said right of
way to an iron pin found at the northeast corner of said parcel of land; proceeding
thence along said right of way South 88 degrees 27 minutes 31 seconds East
127.43 feet to an iron pin found; thence leaving said right of way and proceeding
South 01 degrees 01 minutes 49 seconds East 170.84 feet to an iron pin found;
proceeding thence South 88 degrees 55 minutes 24 seconds East 49.63 feet to an
iron pin found; proceed thence South 00 degrees 57 minutes 41 seconds East
273.62 feet to an iron pin found; proceed thence South 04 degrees 33 minutes 51
seconds East 834.36 feet to a point on the land lot line common to Land Lots
1123 and 1182; the proceed along said land lot line North 88 degrees 54 minutes
40 seconds West 25.34 feet more or less, to a point found at the centerline of a
creek; thence continuing along said land lot line North 89 degrees 40 minutes 54
seconds West 574.13 feet to a one-half inch rebar, said rebar being found at the
intersection of said land lot line and the easterly line of said Winthrope Chase
Development; thence leaving said land lot line proceeding along said Winthrope
Chase Development North 01 degrees 30 minutes 23 seconds West 662.91 feet to
a one-half inch rebar; thence continuing along said Winthrope Chase
Development North 89 degrees 55 minutes 21 seconds West 661.88 feet to a point
found on the land lot line common to land lots 1123 and 1124; thence proceeding
along said land lot line and said Winthrope Chase Development South 02 degrees,
02 minutes, 59 seconds East 200.48 feet to the TRUE POINT OF BEGINNING.
