r«m A RESOLUTION TO HAVE PUBLISHED A NOTICE IN THE CITY'S LEGAL ORGAN
IN THE FORM AS ATTACHED HERETO AS APPENDIX 1, INFORMING THE
PUBLIC OF A PUBLIC HEARING BY THE CITY COUNCIL TO RECEIVE
COMMENTS AND CONSIDER ADOPTION OF ORDINANCES ESTABLISHING
PROCEDURES AND ZONES OR DISTRICTS WITHIN THE TERRITORIAL
BOUNDARIES OF THE CITY REGULATING THE USE AND DEVELOPMENT
STANDARDS OF PROPERTY WITHIN SUCH ZONES, OR DISTRICTS, INCLUDING
ADOPTION OF A ZONING AND COMPREHENSIVE ZONING PLAN AND MAPS
ILLUSTRATING LOCATION OF PROPERTY WITHIN THE CITY BY ZONING
CLASSIFICATIONS CURRENTLY AND FOR THE FUTURE FOR THE
CITY OF MILTON, GEORGIA
The Council of the City of Milton hereby resolves while in regular session on November 21,
2006 at 4:30 pm. as follows:
SECTION 1. That the City Charter for the creation of the municipal corporation of
Milton provides for a transition period for transfer of services and functions from
Fulton County; and,
SECTION 2. That the City Charter provides, during the transition period, the
am authority for the City Council of Milton may at anytime, without the necessity of
any agreement by Fulton County, commence to exercise its planning and zoning
powers, provided the City shall give the County at least thirty (30) days written
notice of the date on which the City will assume the exercise of these powers; and,
SECTION 3. That the City Council desires to assume all planning and zoning
functions for the City on December 22, 2006; and,
SECTION 4. That the City Council does authorize and direct the Mayor, on behalf
of the City to notify the Chair of the Board of Commissioners of Fulton County that
the City of Milton shall assume all responsibility of providing governmental
services and function for planning and zoning within the territorial limits of the
City of Milton, effective December 22, 2006 and submit to the Chair of the Board
of Commissioners of Fulton County a copy of this Resolution certified by the City
Clerk; and,
SECTION 5. That the City Council does authorize and direct the Mayor and the
City Manager to have published a notice in the City's legal organ in the form as
attached hereto as Appendix 1, informing the public of a public hearing by the City
on" Council to receive comments and consider adoption of ordinances establishing
procedures and zones, or districts, within the territorial boundaries of the City

regulating the use and development standards of property within such zones, or
districts, including adoption of a zoning and comprehensive zoning plan and maps
illustrating location of property within the City by zoning classifications, currently
ftwod and for the future; and,
SECTION 6. That the public hearings for this purpose shall be held before the
Mayor and City Council, at Hopewell Middle School, 13060 Cogburn Road, Alpharetta,
Georgia, 30004 at 5:30 p.m., on the 7th day of December, 2006; and at 5:30 p.m. on
the 21" day of December, 2006.
SECTION 7. That this Resolution shall become effective upon its adoption.
BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF MILTON this
21" day of November, 2006

APPENDIX 1
Public Notice
The City Council of Milton, Georgia has scheduled a public hearing to be held at 5:30 p.m., on
Thursday the 7h day of December, 2006 at Hopewell Middle School, 13060 Cogburn Road, Alpharetta,
Georgia, 30004, and a second public hearing before the City Council of Milton, Georgia to be held at
5:30 p.m. on the 21" day of December, 2006 at Hopewell Middle School, 13060 Cogburn Road,
Alpharetta, Georgia, 30004 to receive public comments for consideration and adoption of a Zoning
Ordinance of the City of Milton and such other City Ordinances establishing procedures and zones or
districts within the City of Milton territorial boundaries which regulate the uses and development
standards of property within such zones or districts, including adoption of comprehensive zoning plan
maps and zoning maps showing classification of property within such zones or districts.
The conducting of the public hearing, and adoption of ordinances, comprehensive zoning plan
map and zoning map is to be done in compliance with "The Zoning Procedures Law" of the State of
Georgia, codified as Title 36, Chapter 66 and the Fulton County Zoning Ordinances, as amended.
