HomeMy WebLinkAboutRESOLUTION NO. 06-11-20A RESOLUTION TO IMPOSE A TEMPORARY MORATORIUM FROM DECEMBER 1 THROUGH 22, 2006 UNLESS SOONER TERMINATED TO FINALIZE THE FORMAT AND STRUCTURE OF ZONING APPLICATIONS APPLICATIONS FOR SIGN PERMITS USE PERMITS. BUILDING PERMITS. WITH THE EXCEPTION OF TRADE PERMITS AND DEMOLITION PERMITS WHICH DO NOT RELY UPON THE STANDARDS OF THE ZONING ORDINANCE, AND LAND DISTURBANCE PERMITS, WHICH ARE SUBJECT TO OR RELATED TO ZONING. OR OTHER APPLICATIONS ADDRESSING THE USES AND DEVELOPMENT OF PROPERTY WITHIN THE TERRITORIAL BOUNDARIES OF THE CITY TO ALLOW FOR THE CONSIDERATION AND ADOPTION OF ZONING ORDINANCES. AS DEFINED AND REQUIRED BY THE GEORGIA ZONING PROCEDURES LAW. BE IT RESOLVED by the City Council for the City of Milton, Georgia while in special called meeting on December 1, 2006 at 9:00 a.m. as follows: SECTION 1. That upon completion of preparatory and organization matter related to the new incorporation of the City, the City Council for Milton, as its governing authority, the County Manager of Fulton County has been provided notice that the City shall assume all responsibility for providing governmental service and function for planning and zoning within the territorial limits of the City; and, SECTION 2. Prior to assuming such responsibility, the City Council intends to provide by Ordinance for the administration of its planning and zoning authority as granted to it by the State of Georgia as a chartered municipality; and, SECTION 3. Prior to assuming such responsibility, the City Council intends to provide by Ordinance for the procedures and requirements for planning and zoning of property within the territorial limits of the city; and, SECTION 4. That the laws of Georgia as codified Title 36 Chapter 66 ("The Zoning Procedures Law") provides statutory requirements which must be met by a local government to enact zoning ordinances and make zoning decisions, as defined in said act, requiring publication of notice and public hearing prior to the enactment of zoning ordinances; and, SECTION 5. That the City Council finds it necessary to enact a temporary moratorium to allow the governing authority of the City a minimal time period to have notice published and conduct a public hearing in order to meet the requirements of the Georgia Zoning Procedures Law; and, SECTION 6. That the City Council does hereby impose a moratorium until midnight December 22, 2006 to finalize the format and structure of zoning applications, applications for sign permits, use permits, building permits, with the exception of trade permits and demolition permits which do not rely on the standards of the zoning ordinance, and land disturbance permits, the above being subject to or related to zoning, and other applications addressing the uses and development of property within the territorial boundary of the city to allow for the consideration and adoption of zoning ordinances, as defined and required by the Georgia zoning procedures law. SECTION 7. That the said moratorium shall begin at midnight on December 1, 2006 and end at midnight December 22, 2006, unless sooner terminated by action of the City Council; and, fto.— SECTION 8.
