HomeMy WebLinkAboutORDINANCE NO. 07-02-012STATE OF GEORGIA COUNTY OF FULTON ORDINANCE NO. 07-02-012 AN ORDINANCE TO ESTABLISH THE NORTHWEST FULTON OVERLAY DISTRICT DESIGN REVIEW BOARD BE IT ORDAINED by the City Council of the City of Milton, GA while in a Regular called Council meeting on February 15, 2007 at 7:00 PM as follows: SECTION 1. The Milton City Charter provides that the city may create and the City of Milton Zoning Ordinance requires the City Council to create by ordinance a Northwest Fulton Overlay District Design Review Board; SECTION 2. This Northwest Fulton Overlay District Design Review Board is a seven member advisory board which reports its findings and recommendations to the Community Development Director; SECTION 3, The Board is charged to review all non-residential plans for development within the Northwest Fulton Overlay Zoning District, Crabapple and Birmingham Crossroads Overlay Districts for compliance with the standards within the Zoning Ordinance; SECTION 4, The Board shall make recommendations to the Community Development Department prior to the approval of a Land Disturbance Permit, Building Permit of Primary Variance; SECTION 5. That each Councilperson and the Mayor shall nominate his or her designee for one of the seven positions on the Board; SECTION 6. The Mayor's and Councilperson's designee shall be residents, own land, be business owners, professional architects and/or land planners, who either maintain primary residence and/or businesses anywhere within the City and each of the Councilperson's designees shall reside within his or her respective council districts; SECTION 7. The designees shall be confirmed by a majority vote of the City Council; SECTION 8. The members of the Board shall be a minimum of 21 years of age and be a United States citizen or legal resident. Any member of the Board may be removed from office for cause by a vote of the City Council; SECTION 9. The members of the Board shall serve concurrently with their respective Councilperson as follows: Districts 2, 4, and 6 — 1 (one) year term expiring 12/31/07; after that the term will last for four years Districts 1, 3, and 5 and the Mayor — 3 (three) year term expiring 12/31/09; after that the term will last for four years; SECTION 10. The City Council may provide for the reimbursement for actual and necessary expenses of the Board; SECTION 11. All ordinances, parts of ordinances, or regulations in conflict herewith are repealed.
