Special Called Meeting of the Mayor and Council of the City of Milton was held on Tuesday, March 11,
r•.r 2008 at 6:00 PM, Mayor Joe Lockwood presiding.
CALL TO ORDER
Mayor Lockwood called the Special Called Meeting to order.
ROLL CALL
City Clerk Marchiafava called the roll and made announcements.
Councilmembers Present: Councilmember Karen Thurman, Councilmember Julie Zahner Bailey,
Councilmember Bill Lusk, Councilmember Burt Hewitt, Councilmember Tina D'Aversa, and Councilmember
Alan Tart.
PLEDGE OF ALLEGIANCE
Mayor Lockwood led the Pledge of Allegiance.
APPROVAL OF MEETING AGENDA
City Clerk Marchiafava read Agenda Item No. 08-537.
Approval of the Meeting Agenda
Motion and Vote: Councilmember Zahner Bailey moved to approve the meeting agenda. Councilmember
Thurman seconded the motion. There was no Council discussion. The motion passed unanimously.
PUBLIC COMMENT
Lisa Cauley,14555 Freemanville Road, Milton, GA 30004
Stated she had been advised by a resident at the City Council meeting that the City's Community Development
Director made a statement that developer, Richard Wernick, would not need a variance to do stream restorations
on the property located at 14670 Freemanville Road, which she believed is owned by the Fulton County Board of
Education. Ms. Cauley stated that the streams on the property in question were vital to the river basin water shed
and the health of the water shed in that particular creek. She voiced her concerns over major erosion and
sediment control issues in the stream bed. Before any work can commence and any LDP issued, the Georgia Soil
and Water Conservation Commission must approve the associated erosions, sedimentation and pollution control
plans (ES & PC Plans). That Commission must provide a letter of approval to the City stating the plans are
approved. She inquired if the City of Milton had such a letter. Also, a Notice of Intent or an "NOI" must be filed
by the owner, the Board of Education, to the EPD under the NPDES general permit and a copy of the Notice of
Intent should be submitted to the City as well. Also inquired as to whether an Application for Buffer Impacts
been submitted to the EPD. She asked if the City been given copies of any preconstruction notification to the
Corps of Engineers. Believes the City should know exactly why this needs to be done and was being done to
fulfill mitigation requirements. The City should insist on seeing the full scope of the work before any work
proceeds.
Marilyn Weeber, 14480 Wood Road, Milton, GA 30004
Stated she concurred completely with the previous speaker and her position regarding the property on
Freemanville Road and that she had been involved with the lawsuit that went on regarding that property a few
"on years ago. She asked Council to review the facts very carefully and go back over the case regarding some of the
decisions Fulton County made. She has concerns over carelessness and behind the scene dealings that have been
boo practiced in other governments. She hoped that Milton's elected officials and the people who are paid to watch
over some of these matters would be not subject to that. She asked that Council just look over these issues very
carefully. Believed it was better to proceed with caution than to have to mitigate mistakes that were made.

■... Stated her comments were directed to the proposed high school on Freemanville Road next to the gated section of
White Columns, and that she recently found out that a variance notification had been lifted for Mr. Wernick on
that property sold to the Board of Education. She took some photos holding up a current newspaper for the date
and it indicated that there was no notice posted at this location. There also were no notices throughout the White
Columns Subdivision until just a few days prior to this evening. She had sent an email to Council and to the
Community Development Director, Tom Wilson, asking for a change of date so the community at large could be
notified. Advised Council she felt this was a very serious issue for the community. Ms. Silva voiced her concern
that this matter may be a conflict of interest as she knows that the Community Development Director at one time
was a City of Milton employee and now is an employee of CH2MHill, and wondered how this could affect our
City as we go forward. She asked that Council give some serious attention to this matter especially as it impacts
our environment.
City Clerk Marchiafava stated that Public Comment was completed.
Mayor Lockwood asked Community Development Director Tom Wilson to check into the issue and help
Council be prepared to do what they are supposed to do. Council has heard the public concerns and will check
into the matter further.
City Clerk Marchiafava read the next Agenda Item No. 08-538.
Executive Session for the purpose of discussing personnel.
Motion and Second: Councilmember Thurman moved to adjourn into Executive Session at 6:05 p.m.
Councilmember Lusk seconded the motion. There was no Council discussion. The motion passed unanimously.
RECONVENE
Motion and Vote: Councilmember Lusk moved to reconvene the Special Called Meeting. Councilmember Tart
seconded the motion. There was no Council discussion. The motion passed unanimously.
ADJOURNMENT
Motion and Vote: Councilmember Lusk moved to adjourn the Special Called Meeting.
Councilmember Thurman seconded the motion. There was no Council discussion. The motion passed
unanimously.
After no further business, the meeting of the Milton City Council was adjourned at 8:00 p.m.
