HomeMy WebLinkAboutRESOLUTION NO. 08-02-21STATE OF GEORGIA COUNTY OF FULTON RESOLUTION NO. 08-02-21 A RESOLUTION IN SUPPORT OF HOUSE BILL 975 RELATING TO COUNTIES AND MUNICIPAL us" CORPORATIONS IN GENERAL, SO AS TO PROVIDE THAT IT SHALL BE UNLAWFUL FOR ANY COUNTY OR MUNICIPAL CORPORATION TO ISSUE ANY BACKDATED LICENSE, PERMIT, OR OTHER SIMILAR AUTHORIZATION UNDER CERTAIN CIRCUMSTANCES; TO PROVIDE FOR A CRIMINAL PENALTY; TO PROVIDE FOR RELATED MATTERS; TO STATE LEGISLATIVE INTENT; TO PROVIDE AN EFFECTIVE DATE; TO REPEAL CONFLICTING LAWS; AND FOR OTHER PURPOSES. BE IT RESOLVED by the City Council of the City of Milton, GA while in regular session on February 20, 2008 at 6:00 p.m. as follows: WHEREAS, the Mayor and Council are the governing authority of the City of Milton; and WHEREAS, the Mayor and Council are charged with the protection of the health, safety and welfare of the citizens of the City of Milton; and WHEREAS, the State Legislature has placed the authority and responsibility for permits and licensing within the purview of the various municipal corporations; and WHEREAS, the counties are divested of certain authority upon an act of incorporation of new municipalities, formation of a new county, or annexation; and WHEREAS, the Mayor and Council believe this legislation is in the best interest of the citizens of Milton. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of Milton, Georgia, and it is hereby resolved by the authority of same as follows: The Mayor and Council of the City of Milton hereby go on the record in support of House Bill 975, or similar legislation, relating to counties and municipal corporations in general, so as to provide that it shall be unlawful for any county or municipal corporation to issue any backdated license, permit, or other similar authorization under certain circumstances; to provide for a criminal penalty; to provide for related matters; to state legislative intent; to provide an effective date; to repeal conflicting laws; and for other purposes. BE IT FURTHER RESOLVED that a copy of this Resolution and letter be forwarded to the Governor, the Lt. Governor and to all members of the Georgia General Assembly.
