HomeMy WebLinkAboutRESOLUTION NO. 08-03-23STATE OF GEORGIA COUNTY OF FULTON RESOLUTION NO. 08-03-23 A RESOLUTION TO CREATE THE MILTON DISABILITY AWARENESS COMMITTEE, THE MILTON DISABILITY AWARENESS COMMITTEE BOARD, TO PROVIDE FOR THE POSSIBLE APPOINTMENT OF CERTAIN COMMITTEE 4W."MEMBERS TO ENFORCEMENT POSITIONS, AND FOR OTHER PURPOSES AS DESIGNATED HEREIN WHEREAS, the City of Milton would like to include persons of all abilities in every aspect of community life; and WHEREAS, the City of Milton would like to promote the inclusion of persons of all ability levels through education, advocacy, and influence on public policy. WHEREAS, the City of Milton formed a citizens committee in April 2007 for the purpose of recommending the action for the city with regard to persons with disabilities; and WHEREAS, the City of Milton Disability Awareness citizens committee is hereby named the Milton Disability Awareness Committee (MDAC); and WHEREAS, MDAC governance shall be provided by a Board comprised of seven members of the community, each having experience and/or expertise with persons with various disabilities. WHEREAS, the MDAC Board shall elect a chairman and vice-chairman by majority vote; WHEREAS, the MDAC Board may establish and appoint representatives to as many committees and sub -committees as are determined by the Board to be necessary for the mission of the MDAC to be accomplished; WHEREAS, in addition, the MDAC Board shall authorize and provide for volunteers to fulfill the functions of the MDAC, with said volunteers being full MDAC members, it being understood that all MDAC members will be volunteers; WHEREAS, that the City of Milton believes it in the best interest of the public for those qualified MDAC members satisfying the statutory requirements of O.C.G.A. § 40-6-228 to be empowered by the City of Milton Public Safety Director to enforce the Parking Law for Persons with Disabilities Act, at O.C.G.A. § 40-6-220; and, WHEREAS, staff of the City of Milton will attend the meetings of the MDAC Board but shall hold no official capacity of the committee; and WHEREAS, the mission of the MDAC shall be "The mission of the Milton Disabilities Awareness Committee is to promote the inclusion of persons of all abilities in every aspect of community life through education, advocacy, and influence on public policy." And, WHEREAS, the logo for the Milton Disability Awareness Committee shall be: City Of Niton lity Awareness ornittee [As approved by majority vote of the committee] WHEREAS, all members of the MDAC shall reside in the City of Milton and be at least 21 years of age; and WHEREAS, each person nominated to the MDAC Board shall hold office for a period of two years or until such time as they are no longer able to participate in the committee; and WHEREAS, each person serving on the MDAC Board may be removed from the committee for cause by a majority vote of the committee; which, for purposes of this Resolution shall mean (1) malfeasance or misfeasance in carrying out official functions, (2) unwillingness to carry out official functions, (3) unreasonable number of absences from meetings and/or official events, and (4) any other act or omission that would lead a reasonable person to conclude the committee member is unfit for continued service on the committee; and WHEREAS, the MDAC Board shall meet at regular intervals to perform the tasks and duties of recommending actions to the city staff and city council; and, WHEREAS, each member of the MDAC, including MDAC Board members, shall undertake their respective duties in a volunteer capacity and not be compensated for any time or expenses associated with any assignment or function received by the MDAC Board; and WHEREAS, should any member of the MDAC Board be unable to fulfill their duties, the Board shall nominate a new member to be confirmed by a majority vote of the Board. NOW, THEREFORE, BE IT RESOLVED BY THIS COUNCIL OF THE CITY OF MILTON, GEORGIA, AND IT IS RESOLVED BY THE AUTHORITY OF SAID CITY COUNCIL, that: By passage of this resolution, the City of Milton Mayor and the City Council hereby FWW create the Milton Disability Awareness Committee ("MDAC"), with a Board comprised of seven individuals, to serve as the official citizen's committee to the City of Milton; and, `"'"' BE IT FURTHER RESOLVED that the members of the MDAC Board shall be: Original MDAC Members Ann Coggins, chairman Laura Basham, co-chairman Marcia O'Shaughnessy .,10 Olga Espinola Renee Catanzaro Gary Arnold Neal O'brien Advisory Mark Johnson (nonvoting member) BE IT FURTHER RESOLVED, that qualifications for serving on the MDAC Board, the rules and regulations for Board membership, officers, removal, term limits, disqualification, and volunteer status shall be as set forth in the preamble to this Resolution; BE IT FURTHER RESOLVED, that the MDAC logo shall be as depicted in the preamble to this Resolution; BE IT FURTHER RESOLVED that the Milton Public Safety Director shall appoint any member of the Milton Disability Awareness Committee that meets the statutory requirements in O.C.G.A. § 40-6-228, to wit: that the member is a Permanently Disabled Person as defined in O.C.G.A. § 40-6-221(5), to enforce the provisions of the Parking Law for Persons with Disabilities Act at O.C.G.A. § 40-6-220, et.seq., subject to all rights, obligations and limitations set forth within the Act. (Seal) Approved: Joe Lockw o ayor STATE OF GEORGIA COUNTY OF FULTON RESOLUTION NO. 08-02-23 A RESOLUTION OF THE MILTON CITY COUNCIL EXPRESSING CONCERN OVER THE PROPOSED CONSTRUCTION BY FULTON COUNTY OF A 140 -FOOT ELEVATED WATER STORAGE TANK AT FREEMANVILLE ROAD BE IT RESOLVED by the City Council of the City of Milton, GA while in regular session on February 20, 2008 at 600 p.m. as follows: WHEREAS, the City of Milton has been advised that the Fulton County Public Works Department has proposed a new elevated water storage tank at Freemanville Road in the City of Milton (the "Proposed Water Tank") principally to serve four new developments in the North Fulton area known as the Chatham Subdivision, the Georgia Tech Subdivision, the Peachtree Residential Subdivision, and the Wemick Subdivision (the "Developments"); and WHEREAS, the Proposed Water Tank is proposed to be constructed at a height of 140 feet, which is approximately 14 stories high; and WHEREAS, the Developments joined to form a consortium known as Pritchard Mountain Water, LLC ("Pritchard Mountain Water"), for the purposes of providing water supply to the Developments under contract with Fulton County dated in June of 2006, whereby Pritchard Mountain Water would construct a booster pump at the Freemanville Road site to be conveyed to Fulton County upon completion of construction and, in turn, Fulton County would construct the Proposed Water Tank; WHEREAS, there currently exists a 40 -foot high water ground storage tank at Freemanville Road, which the City of Milton has required to be screened by vegetative buffers so as to preserve the rural nature of the community; and WHEREAS, the Proposed Water Tank will defeat the City's purposes of the vegetative screening requirements as a water tower at the proposed height will be incapable of screening and may threaten the rural nature of the community; and WHEREAS, the City of Milton has been advised by experts in the pertinent field (to wit: Wiedeman & Singleton, Inc. engaged by Pritchard Mountain Water and Fulton County in accord with the contract attached hereto as Exhibit A) that a booster pump with an ground storage tank is sufficient to provide an adequate water supply with appropriate water pressure and water storage, thereby alleviating the need for the Proposed Water Tank; and WHEREAS, the City of Milton has been further advised by experts in the swimpertinent field (Wiedeman & Singleton, Inc. as referenced in the preceding paragraph) that the above -referenced booster pump with ground storage can be constructed at a far lesser cost than the Proposed Water Tank; and WHEREAS, the City of Milton has been advised that Pritchard Mountain Water agrees that a ground storage tank is more desirable than the Proposed Water Tank and would be willing to amend their agreement with Fulton County to provide for same; WHEREAS, a report prepared by Wayne Super was considered meaningful to the City of Milton in adopting this Resolution, and that report is attached hereto as Exhibit B; WHEREAS, the City of Milton recognizes the important public purposes of providing water to the community at a desirable level of pressure and providing for adequate water storage in cases of emergency to avoid interruption of water service; and WHEREAS, the City of Milton, on behalf of its citizens, desires to avoid the construction of the Proposed Water Tank to the extent feasible when balancing the important public purposes associated with construction of the Proposed Water Tank; and WHEREAS, if Fulton County determines that the Proposed Water Tank must be obw constructed to accomplish the above -referenced important public purposes, the City of Milton, on behalf of its citizens, urges Fulton County to work with the City of Milton Design Review Board to construct the Proposed Water Tank in the most aesthetically pleasing manner possible so as to fit in with the surrounding topography and rural nature of the community. NOW, THEREFORE, BE IT RESOLVED, that the Milton City Council does hereby respectively request that Fulton County carefully consider alternative technology that may allow for the avoidance of the Proposed Water Tank, while still meeting the important public purposes of providing water to the community at desired levels of pressure and providing for adequate water storage; and BE IT FURTHER RESOLVED, that the Milton City Council does hereby respectively request, in the alternative, that should Fulton County determine that the construction of the Proposed Water Storage Tank is required to meet the community's water needs, that Fulton County will work with the City of Milton Design Review Board and will take all steps reasonably possible to construct the Proposed Water Storage Tank is the most aesthetically pleasing manner possible so as to fit in with the surrounding topography and the rural nature of the Milton community. Marchiafava, City Cler (Seal) CITY OF MILTON Approved: Joe Loc 7'o ,Plyor 510 STATE OF GEORGIA COUNTY OF FULTON AGREEMENT Exh;L,t A FOR EXTENSION OF WATER NAMS AND FACILITIES (Pritchard Mountain Subdivisions) THIS AGREEMENT, made and entered into this /� day ofCSLuM^ 2006, by and between Fulton County, a political subdivision of the State of Georgia (the "County") and Pritchard Mountain Water, LLC (the "Pritchard Mountain Water"), WITNESSESTH: WHEREAS, Pritchard Mountain Water has requested an extension of the County's existing water mains and facilities located near the Freemanville Road water storage tank in order to make water service available to the proposed residential developments described on Exhibit A, attached hereto and incorporated herein by this reference (the "Pritchard Mountain Subdivisions"); and WHEREAS, Pritchard Mountain Subdivisions are being developed in an elevated area of North Fulton County that is higher than can adequately be served by the County's existing water system; and WHEREAS, the County has initiated a capital improvement project (the "North Fulton Water System Improvements") that includes additional pumping facilities and water main reinforcements that will (among other enhancements) increase the volume of water supplied to the Freemanville Road water storage tank and improve the County's ability to fill the tank during peak demand periods; and WHEREAS, North Fulton Water System Improvements, scheduled to be completed by December of 2009, will not increase the hydraulic gradient above the existing overflow elevation of the Freemanville Road water storage tank; and WHEREAS, Pritchard Mountain Water will require a booster pump station to provide adequate pressure and flow for potable and fire protection water service to the Pritchard Mountain Subdivisions; and WHEREAS, Pritchard Mountain Water and County agree the extension shall be designed, constructed and funded by Pritchard Mountain Water and transferred to County upon terms and conditions herein provided: Pagel of 8 @4 19. Commencement and Duration of Work. Pritchard Mountain Water shall commence work pursuant to this Agreement within 90 days of the execution of this Agreement. Pritchard Mountain Water shall diligently prosecute its work to completion within 24 months after the execution of this Agreement. The capacity of Pritchard Mountain Water's equipment and plan, sequence and method of operation and forces employed, including management and supervisory personnel, shall be such as to insure completion of the work within the time specified in this Agreement. 20. Open Records Act. The Georgia Open Records Act, O.C.G.A. § 50-18-70 et seg, applies to this Agreement. Pritchard Mountain Water acknowledges that any documents or computerized data provided to the County by Pritchard Mountain Water may be subject to release to the public. Pritchard Mountain Water also acknowledges that documents and computerized data created or held by Pritchard Mountain Water in relation to this Agreement may be subject to release to the public, to include documents turned over to the County. Pritchard Mountain Water shall cooperate with and provide assistance to the County in rapidly responding to the Open Records Act requests no later than 24 hours following receipt of any such requests by Pritchard Mountain Water. Pritchard Mountain Water shall promptly comply with the instructions or requests of the County in relation to responding to Open Records Act requests, 21. Contract Term. The term of this Agreement shall commence effective from the date of its execution and continue for twenty-four (24) consecutive months. There is an existing 40 foot high (about 4 stories high), 4 Million Gallon storage tank at the site. The City of Milton'has required the construction of a high vegetative screen around the tank site. Fulton County Public Works Department has proposed a new tank in the area which is 140 feet high (about 14 stories). This will obviate the purpose of the vegetative screen. The new tank is located adjacent to the highest elevation in the county. The tank will be visible for several miles and will become a permanent landmark in the City of Milton. The pressure in the service area is currently insufficient to serve existing residences and proposed new development. In order to increase the pressure, a booster pump station is under construction. The pump station will be ready for service in February 2008. Upon the completion of the Pritchard Mountain Booster Pump Station, it will be possible to raise the pressure in the area by about 40 psi. The pump station meets EPD's reliability criteria for booster pump stations and the plans have received approval from EPD. The pump station facility is approved to operate by EPD without the new tank. The station has many reliability features that will allow the station to operate indefinitely without a tank: 1. The pump station includes a natural gas powered emergency generator. The purpose of the generator is to provide power in the event of a loss of electrical power. 2. There are four pumps. Two are large pumps for fire service. Two are smaller pumps for normal service. Under all service conditions, there is at least one redundant pump. PROTECTING PUBLIC HEALTH AND THE ENVIRONMENT FOR OVER 100 YEARS Alec Rickenbaker January 14, 2008 Page 2 3. The pumps are high quality horizontal split -case types which have an almost indefinite service life. 4. The pump station includes a control system which will be monitored from Fulton County's 24 hour control center. In the event of problems, Fulton County will be immediately notified. In the event of a communications failure, the pump station will continue to operate. 5. The station can be operated in a completely manual mode without the control system in operation. There is, of course, always the possibility of a failure which would leave the station without the ability to serve. No system is completely fail-safe and as a professional matter, we can't guarantee that there will be no interruption of service. However, it should be noted that this type of arrangement is very common and, in general, provides economic and acceptably reliable service to many communities throughout the State of Georgia. Fulton County has proposed the water tank to provide additional redundancy to the pump station. The tank will allow Fulton County to take the station out of service for several hours. In the event of a complete failure of the pump station, the tank will empty. The use of pump stations close coupled to elevated tanks represents a very conservative design philosophy. Water systems are typically very conservative in the way they approach designs and operating procedures. However, in recent years it has become common outside of Fulton County to build ground storage tanks with associated pump stations to serve areas with pressure problems. There is a long history of this type of facility. The City of Atlanta, for example, does not use elevated tanks in Buckhead and relies exclusively on booster pump stations in that area. Service outages on that system, which has been in operation for over forty years, are not an issue in the community. There are four primary reasons the combination of booster pump and ground storage tank has become favored by some other systems in comparison to the use of elevated tanks. 1. Painting elevated tanks is expensive. The expense of shrouding a tank so that the paint overspray does not affect surrounding property owners during painting can be as expensive as the actual painting operation. The use of composite tanks such as Fulton County builds has reduced, but not eliminated, this expense. Elevated tanks should be re- painted on a 10-20 year cycle. 2. Communities have become intolerant of elevated storage tanks. What was once a symbol of civic pride and prosperity in rural communities is now viewed as an eyesore in the suburbs. We are aware of several cases where the community has been willing to pay for additional expense to avoid building elevated storage tanks. 3. The booster pump and ground storage tank is much more flexible than an elevated storage tank. If it becomes necessary to increase pressure in an area, it becomes a matter of changing some pumps rather than building a new tank. Alec Rickenbaker January 14, 2008 Page 3 4. The booster pump station and ground storage tank is usually (but not always) cheaper to build than an elevated tank — especially when large volumes of storage are required. In the specific case of Freemanville Road, the use of the pump station without the elevated storage tank would be much less expensive for Fulton County — because the facilities have been built. In my professional opinion, I believe that the booster pump station currently under construction can serve the area indefinitely in an acceptable manner without an elevated tank. The community should be consulted to determine whether the marginal benefit of additional redundancy is worth the permanent presence of a landmark elevated tank.
