ZM09-01NC09-03 STATE OF GEORGIA COUNTY OF FULTON AN ORDINANCE TO MODIFY CONDITIONS) OF A RESOLUTION BY THE FULTON COUNTY BOARD OF COMMISSIONERS APPROVING PETITION Z85-181 ON OCTOBER APPROXIMATELY 95.696 ACRES. BE IT ORDAINED by the City Council for the City of Milton, Georgia while in regular session on July 20, 2009 at 6:00 p.m. as follows: SECTION 1. That the condition of a resolution by the Fulton County Board of Commissioners, approved on October 2, 1985, for petition Z85-181 that approved a zoning to CUP (Community Unit Plan) property located Providence Road consisting of a total of approximately 95.686 acres, attached hereto and made a part herein; ALL THAT TRACT or parcel of land (13940 Atlanta National Drive)(22 -3811-0807-011-9) of the attached legal description; and Ift" SECTION 2. That the property shall be developed in compliance with the conditions of approval as attached to this ordinance. Any conditions hereby approved (including any site plan) do not authorize the violation of any district regulations; and SECTION 3. That all ordinances or part of ordinances in conflict with the terms of this ordinance are hereby repealed; and SECTION 4. This Ordinance shall become effective upon adoption by the Mayor and City Council and the signature of approval of the Mayor. ORDAINED this 20th day of July, 2009. Zoning Modification petition ZM09-01 /VC09-03 was approved by the Mayor and City Council at the July 20, 2009 hearing, subject to the following conditions: 1. To the owner's agreement to restrict the use of the subject property as follows: e. Provide at least a 100 -foot building setback from the property line of the CUP except for lot # 15 which shall provide a 33 -foot building setback along the west property line where the private recreational court is to be located. 2. To the owner's agreement to abide by the following: d. To reduce the minimum yard setback for a private recreational court to 33 feet on lot 15.
