5. Consideration of Primary Variances
a. V16-011, 13385 Cogburn Road, Ralph Simms
Requests(s):
• To allow two existing accessory structures to encroach into the side setback
• To allow one existing accessory structure to encroach into the rear setback
(Section 64-416,c.i,d)
Motion to approve with conditions: Walter Rekuc
Conditions:
• Per the Fulton County property map shown on page 7 of the staff report

Requests(s):
• To allow a pool, pool deck and pool equipment to encroach into the 75 foot
impervious setback (Section 20-426,2)

Conditions:
• Install a temporary chain link fence along the 50 foot buffer prior to the start of
construction
• Clearly mark the 50 foot buffer/fence with ‘no trespassing’ signs
• Per the site plan by Conroy and Associates, dated 4/2/13
