5. Consideration of Primary Variances
a. V15-008, 5304 Windward Parkway, Stonewalk Shopping Center, Joesph Ahlzadeh,
Requests(s):
To reduce the required parking by 12 spaces (Section 64-1410)
Motion to withdraw: Christopher Bloor
2nd: Sumeet Shaw
Vote: 6-0, Motion approved.
b. V15-009, 15845 Milton Point, Robert Popiel
Requests(s):
To allow a pool , pool deck and pool equipment to be closer than 10 feet from a property
line (Section 64-1609,b,1)
Motion to approve with conditions: Todd Chernik
Conditions:
Per the Brumbelow-Reese survey dated January 19, 2015.
Move the portion of the fence that encroaches onto the Day’s property, back onto the Popiel
property.
Redirect pump discharge from the pool equipment along the east property line toward the north.
Plant screening material along pool, pool deck, and pool equipment as it abuts the property line,
per City of Milton Arborist guidelines.

c. V15-010, 12500 Arnold Mill Road, Oakmont at Crabapple, Matthew Kaczenski
Requests(s):
To allow encroachment into the 50 foot stream buffer for a driveway
To allow encroachment into the 75 foot impervious setback for a driveway (Section 20-
4261,2)
Motion to approve with conditions: Todd Chernik
Per the site plan intended to be dated as 1/20/2015 (but shown as 1/20/2014) from Planners and
Engineers Collaborative.
Conditions:
Pervious driveway materials shall be used within the entire area of encroachment.
Provide mitigation in disturbed areas according to the City Arborist.
Provide replanting in disturbed areas according to the City Arborist.

Vote: 5-0, Motion approved, Walter Rekuc recused himself from this case.
d. V15-012, 13055 Highway 9 N, Target, Clinton Moseley
Requests(s):
To allow a business to have a third wall sign (Section 64-2324, i)
Motion to defer until next month: Christopher Bloor

Vote: 5-0, Motion approved. Walter Rekuc abstained.
