by Angela and Bob. Landscaping to be approved by City
Arborist.
o Trailer to be removed within 30 days of receiving the CO for
the new building.

Rezoning—to develop a 50 lot single family subdivision on 63.57
acres at an overall density of .79 units per acre with minimum ¼
acre lots. Concurrent variance to increase the lot coverage from
20 percent to 50 percent.

To reduce the rear yard setback from 50 feet to 30 feet (Section

Comments:
Why can’t you pull the whole house forward?
You can take off the extra garage and extend the two car garage
out to the right. Make the 2 car garage a 3 car garage.
I am struggling with the hardship. I see some other options on how
to re-architect this. You can move some elements and make it
work.
You know what you have when you buy the lot, and you have to
work within what you have on the lot. Not in accordance with
offering new construction a variance. YOU know what the setback
are, so you need to work with them.
You will need to build a better caser for the BZA.
We have these rules for a reason, we have to find a reason for the
variance.
I don’t think it’s that big of an encroachment. I suggest getting a
letter from the owners of the adjacent house.
Maybe offer some additional landscaping along the
encroachment side.

To allow a fence to exceed the maximum height along an exterior

Comments:
Is the fence containing anything if the fence is open? How is it
containing your horses today? How can it contain your horses if it
doesn’t have a gate?
The laws for development standards in the City of Milton are
pretty clear. We had another case come before us probably
three or four months ago …and unfortunately he had to take it
down. The laws, and the development standards in the City of
Milton are pretty clear. It is unfortunate that you did not get
enough information from the City…We can’t tell this guy…you
have to take that out, and then turn around and make an
exception for someone else. That wouldn’t be fair.
I don’t know about anyone else, but I’m not buying the safety of
your horses whatsoever. You’re doing it because you want to
block the road noise. I sympathize with you. I run up and down
Hopewell Road every day, and I get it. The bottom line is, the
City has adopted ordinances that the City has asked us to
enforce.
These types of fences are not meant for horse farms. They are
privacy fences.
…Why didn’t you build it over by the barn?
