Broadwell House, Condos, Downtown Crabapple, Will Stolz Motion to approve with condition(s): Laura Wysong Conditions:  Work with City architect to add shutters to sides, rear of building  Come to agreement with neighborhood on water quality pond 2nd: Ed Parsons Vote: 5-0, Motion passed. c. Motion to approve with conditions: Rich Johnson Conditions:  Switch the finished on the two buildings.  Building 29 to be all brick, except for the gable end.  Building 30 to be 2 stories siding, brick on the bottom. Return the siding around the side.  Building 29 to have 3 window dormer. 2nd: Tim Bryan Vote: 5-0, Motion passed. e. Phoenix assisted living, Webb Road, Keith Allen Motion to approve with conditions: Conditions:  Work with City architect to explore program elements and balance first floor windows placement on south elevation  Siding to be wrapped on right hand side, per first approved version  Doors on south elevation to match original approved plans 2nd: Ed Parsons Vote: 5-0, Motion passed. 9) Courtesy reviews Consideration of primary variances a. V15-015, 14005 Hagood Road, Jack Barron Requests(s):  To allow an addition to a house to encroach into the 75 foot impervious setback of a stream (Section 20-426, ii) Comments:  No real issues b. V15-017, 13805 Bethany Road, Kim O’Brien Requests(s):  To allow a guest house to encroach into the 50 foot rear yard setback (Section 64-416, 2d) Comments:  The property is complying with the rural viewshed.  The color of the new structure should match the color of the existing house. c. V15-018, 12900 Birmingham Highway, Hannah Flowers Requests(s):  To allow a new house to encroach into the 75 foot impervious setback of a stream (Section 20-426, ii) Conditions:  Gravel drive to remain gravel.  Maintain the rural viewshed. d. V15-019, 785 Owens Lake Road, Jane Davis Requests(s):  To allow an accessory structure to encroach into 50 foot rear setback (Section 64-416, 2d) Comments:  If the structure does not visually impact the neighbors, I can’t imagine any issues.  Get a letter of support from the neighbor. e. V15-020, 765 Tramore Place, Deno Hairston Requests(s):  To allow a sport court to encroach into the 50 foot stream buffer (Section 20-426,i)  To allow a sport court to encroach in to 75 foot impervious setback (Section 20-426,ii)  To allow a sport court to encroach into the 50 rear setback (Section 64- 1602,b,1) Comments:  Bring letters of support from neighbors.  The court cannot be seen from the road or neighboring property. Consideration of Appeals f. V15-016, 1720 Highgrove Club Drive, Joseph Couch i. Variance V14-003, was approved March 18, 2014, allowing a detached garage to encroach into the side setback. ii. Applicant seeks to appeal the Director’s interpretation of condition 1.-- Material, roof pitch, colors, etc. shall match the existing house. Comments:  The neighbors have to live with the decision of the Board.  Our job is to protect the members of the community that are not here, or are not speaking up.  Get letters from surrounding neighbors.  Tell the neighbors and the BZA exactly what you want to.  Compatible does not equal match.  Bring a sample of the materials that you want to use on the building.  City architect shall approve the final design. Consideration of Rezonings/Use permits: g. U15-03/VC15-02, 2780 Bethany Bend, Bob Dike i. To allow the church to be used for an after school program and summer camp. Including installation of a playground and fence. Comments:  No primary colors.  Install four board horse fence, unless alternative is required by code. h. RZ15-15, 3277 Watsons Bend, Scott Reece i. To rezone from AG-1 to R-2A to develop five, one acre lots Comments:  There does not seem to be a better solution. 10) New business--none 11) Old business--none 12) Adjournment
