Motion to defer until next meeting: Steven Check 2nd: Marty Littleton Vote: 5-1, Motion passed. b) 14120 Hopewell Road Motion to approve with conditions: Steven Check Condition(s): Install tree save fence, per City Arborist. 2nd: Perry Mason Vote: 6-0, Motion passed. c) 15155 Freemanville Road Motion to approve: Karl Hausse 2nd: Tim Bryan Vote: 6-0, Motion passed. 5) Final reviews a) 15440 North Valley Creek Lane, Preserve at North Valley, Sales trailer Motion to approve with conditions: Marty Littleton Condition(s): Add skirting around base of trailer. Shrubs to be planted per submitted landscape plan. To allow a house to encroach into the right side setback Comments: The creek/setback was there when you bought the lot. Have you looked at another plan? Suggest that you bring letters of support from other neighbors. Bring original site plan showing stream in another location. Present site plan showing stream buffer. Be prepared to show hardship. b) V12-006, 3105 Bethany Bend, Bethany Gas Station Request(s): 1. To reduce the landscape strip along Highway 9 from 20’ to 16’ 2. To reduce the landscape strip along Bethany Bend from 20’ to 16’ Comments: Safety will be your best approach. Show landscape plan. c) V12-007, 210 Trotter Run, Oxford Lakes Request(s):  To allow a pool and pool deck to encroach into the 50 foot stream buffer and the 25 foot impervious setback No comment. Applicant not present. d) RZ12-05/VC12-02, 633 N Main Street, Jenmark Company Request(s):  To rezone from MIX (Mixed Use) to C-1 (Community Business) to increase the size of the existing building from 6,000 to 12,000 square feet as a retail building. A concurrent variance to delete the 10 foot landscape strip along the south and east property lines. No issues. e) RZ12-07/VC12-04, Deerfield Parkway, Crescent Resources, LLC Request(s):  To rezone from C-1 (Community Business) and O-I (Office-Institutional) to A (Medium Density Apartments) to develop a total of 256 units at a density of 12 units per acre. A concurrent variance to encroach into the 25 foot impervious setback by no more than 5,000 square feet Comment(s):  Looks beautiful. Gorgeous.  Surprised it’s not gated.  Applauds embracing the retention pond, and expanding on them. f) RZ12-07/VC12-04, Redd Road, Redd Road Properties, LLC Request(s):  To rezone from AG-1 (Agricultural) to CUP (Community Unit Plan) to develop an 18 unit single family subdivision and a four part concurrent variance to reduce the 50 foot setback for a new street to 10 feet along the east and west property lines (Section 64-2397); To delete the curb & gutter & sidewalks for all roads within the subdivision. (Section 64-2393); To encroach into the 25 foot impervious setback for a stream Comment(s):  Concerned with the long term issues of the lake.  Would like the applicant and homeowners will work together to find something that will work for everyone.  Suggests adding some sort of landscape buffer along edge of road. 7) Adjournment
